Chapter: Al-Wala' (Right of inheritance) belongs to the one who manumits the slave

باب إِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ
Sahih Muslim 1504g
Ummul Momineen Aisha (رضي الله تعالى عنها) narrated that she had bought Barira ( رضي الله تعالى عنها) from the people of Ansar, but they laid down the condition that the right of inheritance (would vest in them), whereupon Allah's Apostle (صلى الله عليه وآله وسلم) said, the right of inheritance vests with one who shows favor (who emancipates) and Allah's Apostle ( صلى الله عليه وآله وسلم) gave her the choice (either to retain) her matrimonial alliance or break it). Her husband was a slave. Barira (رضي الله تعالى عنها), once gave Ummul Momineen Aisha (رضي الله تعالى عنها) some meat as gift. Allah's Apostle (صلى الله عليه وآله وسلم) said, I wish you could prepare (cook) for us out of this meat. Ummul Momineen Aisha (رضي الله تعالى عنها) said, it has been given as charity to Barira (رضي الله تعالى عنها), whereupon he said, that is charity for her and gift for us.
حضرت عائشہ رضی اللہ تعالی عنہا بیان کرتی ہیں کہ میں نے بریرہ کو انصاریوں سے خریدا، اور انہوں نے ولاء کی شرط لگائی، تو رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ولاء اس کے لیے ہے جس نے احسان کیا ہے (آزادی دی ہے) اور رسول اللہ صلی اللہ علیہ وسلم نے اسے اختیار دیا، اور اس کا شوہر غلام تھا، اور اس نے عائشہ رضی اللہ تعالی عنہا کو بطور ہدیہ گوشت دیا، تو اسے کاش! رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”تم اس گوشت سے ہمارے لیے سالن تیار کرتیں؟“ حضرت عائشہ رضی اللہ تعالی عنہا نے کہا: یہ تو بریرہ کو صدقہ دیا گیا ہے آپ صلی اللہ علیہ وسلم نے فرمایا: ”وہ ہمارے لیے تحفہ ہے۔“
Hazrat Aisha (Razi Allahu Anha) bayan karti hain ke main ne Bareerah ko Ansariyon se khareeda, aur unhon ne wala ki shart lagayi, to Rasool Allah (Sallallahu Alaihi Wa Sallam) ne farmaya: Wala us ke liye hai jis ne ehsan kiya hai (azadi di hai) aur Rasool Allah (Sallallahu Alaihi Wa Sallam) ne use ikhtiyar diya, aur us ka shauhar ghulam tha, aur us ne Aisha (Razi Allahu Anha) ko ba taur e hadiyah gosht diya, to use kaash! Rasool Allah (Sallallahu Alaihi Wa Sallam) ne farmaya: "Tum us gosht se hamare liye salan tayyar kartin?" Hazrat Aisha (Razi Allahu Anha) ne kaha: Yeh to Bareerah ko sadaqah diya gaya hai aap (Sallallahu Alaihi Wa Sallam) ne farmaya: "Woh hamare liye tohfah hai."
وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا حُسَيْنُ بْنُ عَلِيٍّ، عَنْ زَائِدَةَ، عَنْ سِمَاكٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، . أَنَّهَا اشْتَرَتْ بَرِيرَةَ مِنْ أُنَاسٍ مِنَ الأَنْصَارِ . وَاشْتَرَطُوا الْوَلاَءَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الْوَلاَءُ لِمَنْ وَلِيَ النِّعْمَةَ " . وَخَيَّرَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم وَكَانَ زَوْجُهَا عَبْدًا وَأَهْدَتْ لِعَائِشَةَ لَحْمًا فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لَوْ صَنَعْتُمْ لَنَا مِنْ هَذَا اللَّحْمِ " . قَالَتْ عَائِشَةُ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ . فَقَالَ " هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ " .
