Chapter: One who confesses to Zina

باب مَنِ اعْتَرَفَ عَلَى نَفْسِهِ بِالزِّنَا

Abdullah bin Buraida reported on the authority of his father that Ma'iz bin Malik al-Aslami (رضي الله تعالى عنه) came to Allah's Apostle (صلى الله عليه وآله وسلم) and said, Allah's Apostle ( صلى الله عليه وآله وسلم), I have wronged myself, I have committed adultery and I earnestly desire that you should purify me. He turned him away. On the following day, Ma'iz (رضي الله تعالى عنه) again came to him and said, Allah's Apostle (صلى الله عليه وآله وسلم), I have committed adultery. Allah's Apostle (صلى الله عليه وآله وسلم) turned him away for the second time, and sent him to his people saying, do you know if there is anything wrong with his mind. They denied of any such thing in him and said, we do not know him but as a wise good man among us, so far as we can judge. Ma'iz (رضي الله تعالى عنه) came for the third time, and the Prophet (صلى الله عليه وآله وسلم) sent him as he had done before. He asked about him and they informed him that there was nothing wrong with him or with his mind. When it was the fourth time, a ditch was dug for him and the Prophet (صلى الله عليه وآله وسلم) pronounced judgment about him and he was stoned. He (the narrator) said, there came to the Prophet (صلى الله عليه وآله وسلم) a woman from Ghamid and said, Allah's Apostle (صلى الله عليه وآله وسلم), I have committed adultery, so purify me. The Prophet ( صلى الله عليه وآله وسلم) turned her away. On the following day she said, Allah's Apostle (صلى الله عليه وآله وسلم), why do you turn me away? Perhaps, you turn me away as you turned away Ma'iz (رضي الله تعالى عنه). By Allah, I have become pregnant. He said, well, if you insist upon it, then go away until you give birth to (the child). When she was delivered, she came with the child (wrapped) in a rag and said, here is the child whom I have given birth to. He said, go away and suckle him until you wean him. When she had weaned him, she came to the Prophet (صلى الله عليه وآله وسلم) with the child who was holding a piece of bread in his hand. She said, Allah's Apostle ( صلى الله عليه وآله وسلم), here is he as I have weaned him, and he eats food. The Prophet (صلى الله عليه وآله وسلم) entrusted the child to one of the Muslims and then pronounced punishment. And she was put in a ditch up to her chest and he commanded people and they stoned her. Khalid bin Walid ( رضي الله تعالى عنه) came forward with a stone which he flung at her head and there, spurted blood on the face of Khalid (رضي الله تعالى عنه) and so he abused her. Allah's Apostle (صلى الله عليه وآله وسلم) heard Khalid's (رضي الله تعالى عنه) curse that he had hurled upon her. Thereupon the Prophet ( صلى الله عليه وآله وسلم) said, Khalid (رضي الله تعالى عنه), be gentle. By Him in Whose Hand is my life, she has made such a repentance that even if a wrongful tax-collector were to repent, he would have been forgiven. Then giving command regarding her, he prayed over her and she was buried.
حضرت بریدہ رضی اللہ تعلی عنہ بیان کرتے ہیں کہ حضرت ماعز بن مالک اسلمی رضی اللہ تعالی عنہ رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہو کر کہنے لگے، اے اللہ کے رسول صلی اللہ علیہ وسلم ! میں اپنے اوپر ظلم کر چکا ہوں، میں نے زنا کیا ہے اور میں چاہتا ہوں آپ مجھے پاک کر دیں، آپ صلی اللہ علیہ وسلم نے اسے واپس کر دیا، جب اگلا دن آیا، وہ پھر آیا اور کہنے لگا، اے اللہ کے رسول صلی اللہ علیہ وسلم ! تو آپصلی اللہ علیہ وسلم نے دوبارہ واپس کر دیا، رسول اللہ صلی اللہ علیہ وسلم نے اس کی قوم کی طرف پیغام بھیجا اور پوچھا، ”کیا تم اس کی عقل میں کچھ فتور محسوس کرتے ہو یا اس میں کوئی قابل اعتراخ بات پاتے ہو؟“ تو انہوں نے جواب دیا، ہمارے علم میں، اس میں پوری عقل ہے، ہمارے اچھے افراد میں سے ہے، ہماری معلومات یہی ہیں تو وہ سہ بارہ آیا، آپ صلی اللہ علیہ وسلم نے ان کی طرف پھر پیغام بھیجا اور اس کے بارے میں پوچھا، اس کی قوم نے آپ کو بتایا، اس میں کوئی قابل اعتراض بات نہیں ہے اور نہ اس کی عقل میں فتور ہے تو جب چوتھی بار آیا، اس کے لیے گڑھا کھودا گیا، پھر آپصلی اللہ علیہ وسلم نے اس کو رجم کرنے کا حکم دیا، حضرت بریدہ رضی اللہ تعلی عنہ بیان کرتے ہیں، اس کے بعد آپ کے پاس ایک غامدیہ قبیلہ کی عورت آئی اور کہنے لگی، اللہ کے رسول! میں زنا کر چکی ہوں تو مجھے پاک کر دیجئے اور آپ نے اسے واپس کر دیا تو جب اگلا دن آیا، اس نے کہا، اے اللہ کے رسولصلی اللہ علیہ وسلم! آپ مجھے واپس کیوں لوٹاتے ہیں، شاید آپصلی اللہ علیہ وسلم مجھے ماعز کی طرح واپس لوٹانا چاہتے ہیں، اللہ کی قسم! میں تو حاملہ ہو چکی ہوں، آپصلی اللہ علیہ وسلم نے فرمایا: ”اگر تمہیں اصرار ہے تو جاؤ حتی کہ تم بچہ جنو۔“ تو جب اس نے بچہ جنا، وہ اسے ایک کپڑے میں لپیٹ کر لے آئی اور کہا، یہ بچہ میں جن چکی ہوں، آپصلی اللہ علیہ وسلم نے فرمایا: ”جا اسے دودھ پلا حتی کہ اس کا دودھ چھوٹ جائے۔“ تو جب اس نے اس کا دودھ چھڑوایا، وہ آپصلی اللہ علیہ وسلم کے پاس بچہ لے کر آئی، اس کے ہاتھ میں روٹی کا ٹکڑا تھا اور کہنے لگی، اے اللہ کے نبی! میں اس کا دودھ چھڑا چکی ہوں اور یہ کھانا کھانے لگ گیا ہے تو آپصلی اللہ علیہ وسلم نے بچہ ایک مسلمان کے حوالہ کیا، پھر اس کے بارے میں حکم دیا تو اس کے لیے اس کے سینہ تک گڑھا کھودا گیا اور آپصلی اللہ علیہ وسلم کے حکم سے لوگوں نے اسے رجم کر دیا، حضرت خالد بن ولید رضی اللہ تعالی عنہ پتھر لے کر آگے بڑھتے ہیں اور اس کے سر پر مارتے ہیں اور خون حضرت خالد رضی اللہ تعالی عنہ کے چہرہ پر پڑتا ہے، وہ اسے برا بھلا کہتے ہیں، نبی اکرم صلی اللہ علیہ وسلم نے بھی ان کا اس کو برا بھلا کہنا سن لیا آپ صلی اللہ علیہ وسلم نے فرمایا: ”رک جاؤ، اے خالد! اس ذات کی قسم جس کے ہاتھ میں میری جان ہے، اس نے اس قدر سچی توبہ کی ہے، اگر ناجائز طور پر ٹیکس لینے والا بھی ایسی توبہ کرے تو اسے معافی مل جائے۔“ پھر آپصلی اللہ علیہ وسلم نے اس کی نماز جنازہ پڑھنے کا حکم دیا اور نماز پڑھا کر اسے دفن کر دیا۔
Hazrat Buraidah (Radi Allahu Anhu) bayan karte hain ke Hazrat Ma'iz bin Malik Aslami (Radi Allahu Anhu) Rasulullah (Sallallahu Alaihi Wasallam) ki khidmat mein hazir ho kar kehne lage: 'Ay Allah ke Rasul (Sallallahu Alaihi Wasallam)! Main apne upar zulm kar chuka hoon, main ne zina kiya hai aur main chahta hoon aap mujhe paak kar dein.' Aap (Sallallahu Alaihi Wasallam) ne ise wapas kar diya. Jab agla din aaya, woh phir aaya aur kehne laga: 'Ay Allah ke Rasul (Sallallahu Alaihi Wasallam)!' To aap (Sallallahu Alaihi Wasallam) ne dobara wapas kar diya. Rasulullah (Sallallahu Alaihi Wasallam) ne is ki qaum ki taraf paigham bheja aur pucha: 'Kya tum is ki aql mein kuch futoor mehsoos karte ho ya is mein koi qabil-e-aiteraaz baat pate ho?' To unhon ne jawab diya: 'Hamare ilm mein, is mein poori aql hai, hamare ache afraad mein se hai, hamari maloomat yehi hain.' To woh se-bara aaya, aap (Sallallahu Alaihi Wasallam) ne un ki taraf phir paigham bheja aur is ke bare mein pucha. Is ki qaum ne aap ko bataya, is mein koi qabil-e-aiteraaz baat nahi hai aur na is ki aql mein futoor hai. To jab chouthi baar aaya, is ke liye garha khoda gaya, phir aap (Sallallahu Alaihi Wasallam) ne is ko rajm karne ka hukm diya. Hazrat Buraidah (Radi Allahu Anhu) bayan karte hain, is ke baad aap ke paas ek Ghamidiya qabeela ki aurat aayi aur kehne lagi: 'Allah ke Rasul (Sallallahu Alaihi Wasallam)! Main zina kar chuki hoon to mujhe paak kar dijiye.' Aur aap ne ise wapas kar diya. To jab agla din aaya, us ne kaha: 'Ay Allah ke Rasul (Sallallahu Alaihi Wasallam)! Aap mujhe wapas kyun lautate hain, shayad aap (Sallallahu Alaihi Wasallam) mujhe Ma'iz ki tarah wapas lautana chahte hain. Allah ki qasam! Main to hamila ho chuki hoon.' Aap (Sallallahu Alaihi Wasallam) ne farmaya: 'Agar tumhein israr hai to jao hatta ke tum bacha jano.' To jab us ne bacha jana, woh ise ek kapre mein lapait kar le aayi aur kaha: 'Yeh bacha main jan chuki hoon.' Aap (Sallallahu Alaihi Wasallam) ne farmaya: 'Ja ise doodh pila hatta ke is ka doodh choot jaye.' To jab us ne is ka doodh churwaya, woh aap (Sallallahu Alaihi Wasallam) ke paas bacha le kar aayi, is ke hath mein roti ka tukra tha aur kehne lagi: 'Ay Allah ke Nabi (Sallallahu Alaihi Wasallam)! Main is ka doodh chura chuki hoon aur yeh khana khane lag gaya hai.' To aap (Sallallahu Alaihi Wasallam) ne bacha ek musalman ke hawale kiya, phir is ke bare mein hukm diya to is ke liye is ke seene tak garha khoda gaya aur aap (Sallallahu Alaihi Wasallam) ke hukm se logon ne ise rajm kar diya. Hazrat Khalid bin Walid (Radi Allahu Anhu) patthar le kar aage barhte hain aur is ke sar par marte hain aur khoon Hazrat Khalid (Radi Allahu Anhu) ke chehre par parta hai, woh ise bura bhala kehte hain. Nabi Akram (Sallallahu Alaihi Wasallam) ne bhi un ka is ko bura bhala kehna sun liya, aap (Sallallahu Alaihi Wasallam) ne farmaya: 'Ruk jao, ay Khalid! Us dhaat ki qasam jis ke hath mein meri jaan hai, is ne is qadar sachi tauba ki hai, agar najaiz taur par tax lene wala bhi aisi tauba kare to ise muafi mil jaye.' Phir aap (Sallallahu Alaihi Wasallam) ne is ki namaz-e-janaza parhne ka hukm diya aur namaz parha kar ise dafan kar diya.
وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نُمَيْرٍ، ح وَحَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ، اللَّهِ بْنِ نُمَيْرٍ - وَتَقَارَبَا فِي لَفْظِ الْحَدِيثِ - حَدَّثَنَا أَبِي، حَدَّثَنَا بَشِيرُ بْنُ الْمُهَاجِرِ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ بُرَيْدَةَ، عَنْ أَبِيهِ، أَنَّ مَاعِزَ بْنَ مَالِكٍ الأَسْلَمِيَّ، أَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي قَدْ ظَلَمْتُ نَفْسِي وَزَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي . فَرَدَّهُ فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي قَدْ زَنَيْتُ . فَرَدَّهُ الثَّانِيَةَ فَأَرْسَلَ رَسُولُ اللَّهِ صلى الله عليه وسلم إِلَى قَوْمِهِ فَقَالَ " أَتَعْلَمُونَ بِعَقْلِهِ بَأْسًا تُنْكِرُونَ مِنْهُ شَيْئًا " . فَقَالُوا مَا نَعْلَمُهُ إِلاَّ وَفِيَّ الْعَقْلِ مِنْ صَالِحِينَا فِيمَا نُرَى فَأَتَاهُ الثَّالِثَةَ فَأَرْسَلَ إِلَيْهِمْ أَيْضًا فَسَأَلَ عَنْهُ فَأَخْبَرُوهُ أَنَّهُ لاَ بَأْسَ بِهِ وَلاَ بِعَقْلِهِ فَلَمَّا كَانَ الرَّابِعَةَ حَفَرَ لَهُ حُفْرَةً ثُمَّ أَمَرَ بِهِ فَرُجِمَ . قَالَ فَجَاءَتِ الْغَامِدِيَّةُ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي قَدْ زَنَيْتُ فَطَهِّرْنِي . وَإِنَّهُ رَدَّهَا فَلَمَّا كَانَ الْغَدُ قَالَتْ يَا رَسُولَ اللَّهِ لِمَ تَرُدُّنِي لَعَلَّكَ أَنْ تَرُدَّنِي كَمَا رَدَدْتَ مَاعِزًا فَوَاللَّهِ إِنِّي لَحُبْلَى . قَالَ " إِمَّا لاَ فَاذْهَبِي حَتَّى تَلِدِي " . فَلَمَّا وَلَدَتْ أَتَتْهُ بِالصَّبِيِّ فِي خِرْقَةٍ قَالَتْ هَذَا قَدْ وَلَدْتُهُ . قَالَ " اذْهَبِي فَأَرْضِعِيهِ حَتَّى تَفْطِمِيهِ " . فَلَمَّا فَطَمَتْهُ أَتَتْهُ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ هَذَا يَا نَبِيَّ اللَّهِ قَدْ فَطَمْتُهُ وَقَدْ أَكَلَ الطَّعَامَ . فَدَفَعَ الصَّبِيَّ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ ثُمَّ أَمَرَ بِهَا فَحُفِرَ لَهَا إِلَى صَدْرِهَا وَأَمَرَ النَّاسَ فَرَجَمُوهَا فَيُقْبِلُ خَالِدُ بْنُ الْوَلِيدِ بِحَجَرٍ فَرَمَى رَأْسَهَا فَتَنَضَّحَ الدَّمُ عَلَى وَجْهِ خَالِدٍ فَسَبَّهَا فَسَمِعَ نَبِيُّ اللَّهِ صلى الله عليه وسلم سَبَّهُ إِيَّاهَا فَقَالَ " مَهْلاً يَا خَالِدُ فَوَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَغُفِرَ لَهُ " . ثُمَّ أَمَرَ بِهَا فَصَلَّى عَلَيْهَا وَدُفِنَتْ .
