Mention of the avoidance of combat by Sa'd ibn Abi Waqqas (may Allah be pleased with him)

Judge Abu Bakr narrates that when this statement of Qatham was mentioned in the court of Judge Ismail bin Ishaq, he said: "Inheritance is granted based on lineage or allegiance. And there is no disagreement among the scholars that a nephew does not inherit in the presence of an uncle." This consensus proves that Ali inherited only knowledge from the Messenger of Allah, peace and blessings be upon him. And the following Hadith supports the statement of the Judge.
" قاضی ابوبکر بیان کرتے ہیں کہ قاضی اسماعیل بن اسحاق کے ہاں حضرت قثم کا یہ قول ذکر کیا گیا تو انہوں نے فرمایا : وراثت تو نسب یا ولاء کی بناء پر ملا کرتی ہے ۔ اور اہل علم کا اس بارے میں کوئی اختلاف نہیں ہے کہ چچا کی موجودگی میں بھتیجا وارث نہیں بنتا ۔ اس اجماع سے ثابت ہوا کہ حضرت علی نے رسول اللہ ﷺ سے صرف علم کی وراثت پائی تھی ۔ اور قاضی کی اس بات کی تائید درج ذیل حدیث سے ہوتی ہے ۔"
Qazi Abubakr bayan karte hain keh Qazi Ismail bin Ishaq ke han Hazrat Qasim ka yeh qaul zikar kiya gaya to unhon ne farmaya: Warasat to nasab ya wala ki bunyad per mila karti hai. Aur ahl e ilm ka is bare mein koi ikhtilaf nahin hai keh chacha ki mojoodgi mein bhateeja waris nahin banta. Iss ijma se sabit hua keh Hazrat Ali ne Rasul Allah ﷺ se sirf ilm ki warasat pai thi. Aur Qazi ki iss baat ki taeed darj zel hadis se hoti hai.
سَمِعْتُ قَاضِي الْقُضَاةَ أَبَا الْحَسَنِ مُحَمَّدَ بْنَ صَالِحٍ الْهَاشِمِيَّ يَقُولُ: سَمِعْتُ أَبَا عُمَرَ الْقَاضِي يَقُولُ: سَمِعْتُ إِسْمَاعِيلَ بْنَ إِسْحَاقَ الْقَاضِي يَقُولُ: وَذُكِرَ لَهُ قَوْلُ قُثَمَ هَذَا، فَقَالَ: «إِنَّمَا يَرِثُ الْوَارِثُ بِالنَّسَبِ أَوْ بِالْوَلَاءِ، وَلَا خِلَافَ بَيْنَ أَهْلِ الْعِلْمِ أَنَّ ابْنَ الْعَمِّ لَا يَرِثُ مَعَ الْعَمِّ، فَقَدْ ظَهَرَ بِهَذَا الِإِجْمَاعِ أَنَّ عَلِيًّا وَرِثَ الْعِلْمَ مِنَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ دُونَهُمْ، وَبِصِحَّةِ مَا ذَكَرَهُ الْقَاضِي» [التعليق - من تلخيص الذهبي] 4634 - سكت عنه الذهبي في التلخيص
