Mustadrak Al Hakim 7959
Zaid bin Thabit (may Allah be pleased with him) narrates: The ruling regarding the inheritance of real siblings is that if the deceased has a son or a father, then the brothers do not get anything. ** This Hadith is Sahih (authentic) according to the criteria of Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) but the two Sheikhs (may Allah have mercy on them both) did not narrate it. However, Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) have narrated another Hadith in which this Fatwa (religious ruling) of Zaid bin Thabit (may Allah be pleased with him) is present.
" حضرت زید بن ثابت رضی اللہ عنہ فرماتے ہیں : سگے بہن بھائیوں کی وراثت کا حکم یہ ہے کہ مرنے والے کی اولاد میں اگر کوئی لڑکا موجود ہو یا اس کا باپ موجود ہو تو بھائیوں کو کچھ نہیں ملتا ۔ ٭٭ یہ حدیث امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ کے معیار کے مطابق صحیح ہے لیکن شیخین رحمۃ اللہ علیہما نے اس کو نقل نہیں کیا ۔ تاہم امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ نے ایک اور حدیث بیان کی ہے جس میں حضرت زید بن ثابت رضی اللہ عنہ کا یہ فتویٰ موجود ہے ۔"
Hazrat Zaid bin Sabit (رضي الله تعالى عنه) farmate hain : sagey behen bhaiyon ki warasat ka hukum ye hai ke marne wale ki aulad mein agar koi ladka maujood ho ya uska baap maujood ho to bhaiyon ko kuchh nahin milta . ** Ye hadees Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ke miyaar ke mutabiq sahih hai lekin Shaykhayn Rahmatullah Alaihema ne isko naqal nahin kiya . Taham Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ne ek aur hadees bayaan ki hai jis mein Hazrat Zaid bin Sabit (رضي الله تعالى عنه) ka ye fatwa maujood hai .
حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثَنَا بَحْرُ بْنُ نَصْرٍ، ثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ، أَخْبَرَنِي ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ، عَنْ أَبِيهِ، قَالَ: «مِيرَاثُ الْإِخْوَةِ مِنَ الْأَبِ وَالْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ الذِّكْرِ وَلَا مَعَ وَلَدِ الِابْنِ وَلَا مَعَ الْأَبِ شَيْئًا» هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ، وَقَدِ اتَّفَقَا عَلَى غَيْرِ حَدِيثٍ مِثْلِ هَذَا مِنْ فَتْوَى زَيْدِ بْنِ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ "" [التعليق - من تلخيص الذهبي] 7959 - على شرط البخاري ومسلم
