Mustadrak Al Hakim 8073
Jundub al-Khayr (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "The punishment of the sorcerer is that his head should be struck off with a sword." ** This hadith is sahih al-isnad (authentic in its chain of narration), but Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) did not narrate it. The reason Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) omitted the narration of Ismail ibn Muslim is that it is gharib sahih (authentic but with a unique chain of narration). And there is another hadith with an opposing meaning that supports this, and that hadith meets the criteria of both Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) (that hadith is mentioned below).
" حضرت جندب الخیر فرماتے ہیں کہ رسول اللہ ﷺ نے ارشاد فرمایا : جادوگر کی سزا یہ ہے کہ تلوار کے ساتھ اس کی گردن اڑا دی جائے ۔ ٭٭ یہ حدیث صحیح الاسناد ہے لیکن امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ نے اس کو نقل نہیں کیا ۔ امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ نے اسماعیل بن مسلم کی روایت چھوڑی ہے تو اس کی وجہ یہ ہے کہ وہ غریب صحیح ہے ۔ اور اس مفہوم کی متضاد مفہوم والی ایک حدیث اس کی شاہد ہے اور وہ حدیث امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ دونوں کے معیار پر پوری بھی ہے ( وہ حدیث درج ذیل ہے )"
Hazrat Jundab al Khair farmate hain ke Rasool Allah SAW ne irshad farmaya: Jaduugar ki saza yeh hai ke talwar ke sath uski gardan uraa di jaye. ** Yeh hadees sahih al isnad hai lekin Imam Bukhari rehmatullah alaih aur Imam Muslim rehmatullah alaih ne isko naqal nahin kya. Imam Bukhari rehmatullah alaih aur Imam Muslim rehmatullah alaih ne Ismail bin Muslim ki riwayat chori hai to uski wajah yeh hai ke woh ghareeb sahih hai. Aur is mafhoom ki mutzad mafhoom wali ek hadees iski shahid hai aur woh hadees Imam Bukhari rehmatullah alaih aur Imam Muslim rehmatullah alaih donon ke miyaar par puri bhi hai (woh hadees darj zail hai).
حَدَّثَنَا عَلِيُّ بْنُ حَمْشَاذَ الْعَدْلُ، ثَنَا إِسْمَاعِيلُ بْنُ قُتَيْبَةَ، وَالْحَسَنُ بْنُ عَبْدِ الصَّمَدِ، قَالَا: حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَنْبَأَ أَبُو مُعَاوِيَةَ، ثَنَا إِسْمَاعِيلُ بْنُ مُسْلِمٍ، عَنِ الْحَسَنِ، عَنْ جُنْدُبِ الْخَيْرِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «حَدُّ السَّاحِرِ ضَرْبَةٌ بِالسَّيْفِ» هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَإِنَّ كَانَ الشَّيْخَانِ تَرَكَا حَدِيثَ إِسْمَاعِيلَ بْنِ مُسْلِمٍ فَإِنَّهُ غَرِيبٌ صَحِيحٌ وَلَهُ شَاهِدٌ صَحِيحٌ عَلَى شَرْطِهِمَا جَمِيعًا فِي ضِدِّ هَذَا "" [التعليق - من تلخيص الذهبي] 8073 - صحيح غريب
