Mustadrak Al Hakim 8131
Wabra Kalbi narrated: Khalid bin Waleed (may Allah be pleased with him) sent me to Umar (may Allah be pleased with him). I came to you while you were in the mosque, and with you were Uthman bin Affan, Ali, Abdur Rahman bin Auf, Talha, and Zubair (may Allah be pleased with them all). They were all sitting in the mosque on cushions. I said: Khalid bin Waleed (may Allah be pleased with him) has sent me to you. He sends you greetings and says that people have become heavily indulged in alcohol and they have started to consider the punishments as insignificant. Umar (may Allah be pleased with him) said: All these people are present here, ask them about it. Ali (may Allah be pleased with him) said: My opinion is that when a person gets intoxicated, he talks nonsense, and when he talks nonsense, he lies, and the punishment for a liar is 80 lashes, so he should receive 80 lashes. Umar (may Allah be pleased with him) said: Convey this opinion of Ali (may Allah be pleased with him) to your companion. So, Khalid bin Waleed (may Allah be pleased with him) implemented 80 lashes. Umar (may Allah be pleased with him) also implemented 80 lashes. If a healthy intoxicated person was brought to Umar (may Allah be pleased with him), he would lash him 80 times, and if a weak, frail intoxicated person was brought, he would lash him 40 times. Then, Uthman (may Allah be pleased with him) also continued the same punishment of 80 and 40 lashes. ** This hadith has a sahih chain of narration, but Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him) have not narrated it.
" وبرہ کلبی بیان کرتے ہیں : حضرت خالد بن ولید رضی اللہ عنہ نے مجھے حضرت عمر رضی اللہ عنہ کی جانب بھیجا ، میں آپ کے پاس آیا ، آپ اس وقت مسجد میں تھے اور آپ کے ہمراہ حضرت عثمان بن عفان ، حضرت علی ، حضرت عبدالرحمن بن عوف ، حضرت طلحہ اور حضرت زبیر رضی اللہ عنہم بھی موجود تھے ، سب مسجد میں تکیہ لگائے بیٹھے تھے ۔ میں نے کہا : مجھے حضرت خالد بن ولید نے آپ کی جانب بھیجا ہے ، وہ آپ کو سلام کہہ رہے تھے ، اور فرما رہے تھے ، لوگ شراب میں بہت ڈوب چکے ہیں ، اور ان لوگوں نے سزاؤں کو بہت حقیر سمجھا ہوا ہے ۔ حضرت عمر رضی اللہ عنہ نے فرمایا : یہ سب لوگ یہاں موجود ہیں ، آپ اس بابت ان سے پوچھ لیجئے ، حضرت علی رضی اللہ عنہ نے فرمایا : میرا خیال یہ ہے کہ جب آدمی کو نشہ چڑھتا ہے ، تو وہ بکواسات کرتا ہے ، اور جب بکواسات کرتا ہے تو جھوٹ بولتا ہے اور جھوٹ بولنے والے کی سزا 80 کوڑے ہیں ، اس لیے اس کے 80 کوڑے ہونے چاہئیں ، حضرت عمر رضی اللہ عنہ نے فرمایا : اپنے ساتھی کو حضرت علی رضی اللہ عنہ کی یہ بات پہنچا دو ، چنانچہ حضرت خالد بن ولید رضی اللہ عنہ نے 80 کوڑے لگوائے ، حضرت عمر رضی اللہ عنہ نے بھی 80 کوڑے لگوائے ، اور حضرت عمر رضی اللہ عنہ کے پاس اگر کوئی صحتمند نشئی لایا جاتا تو آپ اس کو 80 کوڑے لگواتے اور اگر کوئی کمزور لاغر نشئی لایا جاتا تو آپ اس کو 40 کوڑے لگواتے ، پھر حضرت عثمان رضی اللہ عنہ نے بھی اسی طرح 80 اور 40 کوڑوں کی سزا کو جاری رکھا ۔ ٭٭ یہ حدیث صحیح الاسناد ہے لیکن امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ نے اس کو نقل نہیں کیا ۔"
Waabara Kalbi bayan karte hain: Hazrat Khalid bin Waleed (رضي الله تعالى عنه) ne mujhe Hazrat Umar (رضي الله تعالى عنه) ki jaanib bheja, main aapke paas aaya, aap us waqt masjid mein the aur aapke hamrah Hazrat Usman bin Affan, Hazrat Ali, Hazrat Abdur Rahman bin Auf, Hazrat Talha aur Hazrat Zubair (رضي الله تعالى عنه) bhi maujood the, sab masjid mein takiya lagaye baithe the. Maine kaha: Mujhe Hazrat Khalid bin Waleed ne aapki jaanib bheja hai, woh aapko salaam keh rahe the, aur farma rahe the, log sharaab mein bahut doob chuke hain, aur in logon ne sazaon ko bahut haqir samjha hua hai. Hazrat Umar (رضي الله تعالى عنه) ne farmaya: Yeh sab log yahan maujood hain, aap is baabat in se pooch lijiye, Hazrat Ali (رضي الله تعالى عنه) ne farmaya: Mera khayal yeh hai ki jab aadmi ko nasha chadhta hai, toh woh bakwasat karta hai, aur jab bakwasat karta hai toh jhoot bolta hai aur jhoot bolne wale ki saza 80 kore hain, isliye uske 80 kore hone chahiyen, Hazrat Umar (رضي الله تعالى عنه) ne farmaya: Apne saathi ko Hazrat Ali (رضي الله تعالى عنه) ki yeh baat pahuncha do, chunancha Hazrat Khalid bin Waleed (رضي الله تعالى عنه) ne 80 kore lagwaye, Hazrat Umar (رضي الله تعالى عنه) ne bhi 80 kore lagwaye, aur Hazrat Umar (رضي الله تعالى عنه) ke paas agar koi sehatmand nashai laya jata toh aap usko 80 kore lagwate aur agar koi kamzor laghar nashai laya jata toh aap usko 40 kore lagwate, phir Hazrat Usman (رضي الله تعالى عنه) ne bhi isi tarah 80 aur 40 kodon ki saza ko jari rakha. ** Yeh hadees sahih al-isnad hai lekin Imam Bukhari Rahmatullah Alaih aur Imam Muslim Rahmatullah Alaih ne isko naqal nahin kiya.
قَالَ الزُّهْرِيُّ: فَحَدَّثَنِي حُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنْ وَبَرَةَ الْكَلْبِيِّ، قَالَ: أَرْسَلَنِي خَالِدُ بْنُ الْوَلِيدِ إِلَى عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا فَأَتَيْتُهُ وَهُوَ فِي الْمَسْجِدِ مَعَهُ عُثْمَانُ بْنُ عَفَّانَ وَعَلِيٌّ وَعَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ وَطَلْحَةُ وَالزُّبَيْرُ رَضِيَ اللَّهُ عَنْهُمْ مُتَّكِئٌ مَعَهُ فِي الْمَسْجِدِ فَقُلْتُ: "" إِنَّ خَالِدَ بْنَ الْوَلِيدِ أَرْسَلَنِي إِلَيْكَ وَهُوَ يَقْرَأُ عَلَيْكَ السَّلَامَ وَيَقُولُ: إِنَّ النَّاسَ قَدِ انْهَمَكُوا فِي الْخَمْرِ وَتَحَاقَرُوا الْعُقُوبَةَ، فَقَالَ عُمَرُ: هُمْ هَؤُلَاءِ عِنْدَكَ فَسَلْهُمْ، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: نَرَاهُ إِذَا سَكِرَ هَذَى وَإِذَا هَذَى افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ، فَقَالَ عُمَرُ: أَبْلِغْ صَاحِبَكَ مَا قَالَ: فَجَلَدَ خَالِدٌ ثَمَانِينَ وَجَلَدَ عُمَرُ ثَمَانِينَ، وَكَانَ عُمَرُ إِذَا أُتِيَ بِالرَّجُلِ الْقَوِيِّ الْمُنْهَمِكِ فِي الشَّرَابِ جَلَدَهُ ثَمَانِينَ وَإِذَا أُتِيَ بِالرَّجُلِ الضَّعِيفِ الَّتِي كَانَتْ مِنْهُ الزَّلَّةُ جَلَدَ أَرْبَعِينَ ثُمَّ جَلَدَ عُثْمَانُ ثَمَانِينَ وَأَرْبَعِينَ «هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ» [التعليق - من تلخيص الذهبي] 8131 - صحيح
