Chapter: What The Guardian Is Entitled To Of An Orphan's Property If He Takes Care Of It

باب مَا لِلْوَصِيِّ مِنْ مَالِ الْيَتِيمِ إِذَا قَامَ عَلَيْهِ

Sunan an-Nasa'i 3668

It was narrated that Jabir said: Abdullah bin 'Amr bin Haram died, leaving behind debts. I asked the Messenger of Allah to intercede with his creditors so that they would waive part of the debt. He asked them to do that but they refused. The Prophet said to me: 'Go and sort your dates into their different kinds: The 'Ajwah on one side, the cluster of Ibn Zaid on another side, and so on. Then send for me.' I did that, then the Messenger of Allah came and sat at the head or in the middle of the heaps. Then he said: 'Measure them out for the people.' So I measured them out for them until I had paid them all off, and my dates were left as if nothing had been taken from them.

عبداللہ بن عمرو بن عاص رضی الله عنہما سے روایت ہے کہ ایک شخص نے نبی اکرم ﷺ کے پاس آ کر عرض کیا: میں محتاج و فقیر ہوں، میرے پاس کچھ بھی نہیں ہے اور میری سرپرستی میں ایک یتیم ہے۔ آپ نے فرمایا: ”یتیم کے مال سے کھا لیا کرو ( لیکن دیکھو ) فضول خرچی اور اسراف مت کرنا اور نہ ہی یتیم کا مال لے لے کر اپنا مال بڑھانا“۔

Abdul-illah bin Amr bin As radhiyallahu anhuma se riwayat hai ke aik shakhs ne Nabi-e-Akram (صلى الله عليه وآله وسلم) ke pas a kar arz kiya: main muhtaj o faqir hun, mere pas kuchh bhi nahin hai aur meri sarparasti mein ek yatim hai. Aap ne farmaya: ''Yatim ke mal se kha liya karo (lekin dekho) fudul kharchi aur israf mat karna aur nahin hi yatim ka mal le le kar apna mal badhana''.

أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ، قَالَ حَدَّثَنَا خَالِدٌ، عَنْ حُسَيْنٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَجُلاً، أَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ إِنِّي فَقِيرٌ لَيْسَ لِي شَىْءٌ وَلِي يَتِيمٌ‏.‏ قَالَ ‏"‏ كُلْ مِنْ مَالِ يَتِيمِكَ غَيْرَ مُسْرِفٍ وَلاَ مُبَاذِرٍ وَلاَ مُتَأَثِّلٍ ‏"‏‏.‏

Sunan an-Nasa'i 3669

It was narrated that Jabir bin 'Abdullah said: My father owed some dates to a Jew. He was killed on the Day of Uhud and he left behind two gardens. The dates owed to the Jew would take up everything in the two gardens. The Prophet said: 'Can you take half this year and half next year?' But the Jew refused. The Prophet said: 'When the time to pick the dates comes, call me.' So I called him and he came, accompanied by Abu Bakr. The dates were picked and weighed from the lowest part of the palm trees, and the Messenger of Allah was praying for blessing, until we paid off everything that we owed him from the smaller of the two gardens, as calculated by 'Ammar. Then I brought them some fresh dates and water and they ate and drank, then he said: 'This is part of the blessing concerning which you will be questioned.'

روایت ہے کہ جابر بن عبد اللہ نے کہا: میرے والد پر ایک یہودی کا کچھ کھجوروں کا قرض تھا۔ وہ احد کے دن شہید ہوئے اور انہوں نے دو باغ چھوڑے۔ یہودی کا قرض ان دونوں باغات کی تمام کھجوروں کو لے لیتا۔ نبی (صلى الله عليه وآله وسلم) نے فرمایا: 'کیا تم اس سال کا آدھا اور اگلے سال کا آدھا لے سکتے ہو؟' لیکن یہودی نے انکار کر دیا۔ نبی (صلى الله عليه وآله وسلم) نے فرمایا: 'جب کھجوریں توڑنے کا وقت آئے، تو مجھے بلانا۔' لہٰذا میں نے انہیں بلایا اور وہ ابو بکر کے ساتھ تشریف لائے۔ کھجوریں توڑی گئیں اور نچلے حصے کی کھجوریں تولی گئیں، اور رسول اللہ (صلى الله عليه وآله وسلم) برکت کی دعا کر رہے تھے، یہاں تک کہ ہم نے جو کچھ بھی اس پر واجب الادا تھا، اسے دونوں باغات میں سے چھوٹے باغ سے ادا کر دیا، جیسا کہ عمار نے حساب لگایا۔ پھر میں نے انہیں کچھ تازہ کھجوریں اور پانی پیش کیا اور انہوں نے کھایا اور پیا، پھر انہوں نے فرمایا: 'یہ اسی برکت کا حصہ ہے جس کے بارے میں تم سے سوال کیا جائے گا۔'

Riwayat hai ke Jaber bin Abdullah ne kaha: Mere wald par ek Yahudi ka kuchh khajooron ka qarz tha. Woh Ahad ke din shaheed huwe aur unhon ne do bagh chhore. Yahudi ka qarz in donon baghon ki tamam khajooron ko le leta. Nabi (sallallahu alaihi wa aalihi wasallam) ne farmaya: 'Kya tum is saal ka aadha aur agle saal ka aadha le sakte ho?' Lekin Yahudi ne inkar kar diya. Nabi (sallallahu alaihi wa aalihi wasallam) ne farmaya: 'Jab khajooriyan todne ka waqt aaye, to mujhe bulana.' Lahanza main ne unhen bulaya aur woh Abu Bakr ke sath tashreef laye. Khajooriyan torri gain aur nichle hisse ki khajooriyan toli gain, aur Rasoolullah (sallallahu alaihi wa aalihi wasallam) barkat ki dua kar rahe the, yahan tak ke hum ne jo kuchh bhi is par wajib al-ada tha, usse donon baghon mein se chhote bagh se ada kar diya, jesa ke Umar ne hisaab lagaya. Phir main ne unhen kuchh tazah khajooriyan aur pani pesh kiya aur unhon ne khaaya aur piya, phir unhon ne farmaya: 'Yeh usi barkat ka hissa hai jis ke baare mein tum se sawal kiya jayega.'

أَخْبَرَنَا أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ، قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ الصَّلْتِ، قَالَ حَدَّثَنَا أَبُو كُدَيْنَةَ، عَنْ عَطَاءٍ، - وَهُوَ ابْنُ السَّائِبِ - عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ لَمَّا نَزَلَتْ هَذِهِ الآيَةُ ‏{‏وَلاَ تَقْرَبُوا مَالَ الْيَتِيمِ إِلاَّ بِالَّتِي هِيَ أَحْسَنُ‏}‏ وَ‏{‏إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَى ظُلْمًا‏}‏قَالَ اجْتَنَبَ النَّاسُ مَالَ الْيَتِيمِ وَطَعَامَهُ فَشَقَّ ذَلِكَ عَلَى الْمُسْلِمِينَ فَشَكَوْا ذَلِكَ إِلَى النَّبِيِّ صلى الله عليه وسلم فَأَنْزَلَ اللَّهُ ‏{‏وَيَسْأَلُونَكَ عَنِ الْيَتَامَى قُلْ إِصْلاَحٌ لَهُمْ خَيْرٌ‏}‏ إِلَى قَوْلِهِ ‏{‏لأَعْنَتَكُمْ‏}‏‏.‏

Sunan an-Nasa'i 3670

It was narrated that Jabir bin 'Abdullah said: My father died owing debts. I offered to his creditors that they could take the fruits in lieu of what he owed them, but they refused as they thought that it would not cover the debt. I went to the Messenger of Allah and told him about that, he said: 'When you pick the dates and have put them in the Mirbad (place for drying dates), call me.' When I had picked the dates and put them in the Mirbad, I went to the Messenger of Allah and he came, accompanied by Abu Bakr and 'Umar. He sat on (the dates) and prayed for blessing. Then he said: 'Call your creditors and pay them off.' I did not leave anyone to whom my father owed anything but I paid him off, and I had thirteen Wasqs left over. I mentioned that to him and he smiled and said: 'Go to Abu Bakr and 'Umar and tell them about that.' So I went to Abu Bakr and 'Umar and told them about that, and they said: 'We knew, when the Messenger of Allah did what he did, that this would happen.'

روایت ہے کہ جابر بن عبد اللہ نے کہا: میرے والد قرض دار تھے۔ میں نے ان کے قرض خواہوں کو پیشکش کی کہ وہ ان کی جگہ پھل لے لیں، لیکن انہوں نے انکار کر دیا کیونکہ وہ سمجھتے تھے کہ یہ قرض کو پورا نہیں کرے گا۔ میں رسول اللہ (صلى الله عليه وآله وسلم) کے پاس گیا اور ان کو اس بارے میں بتایا، تو انہوں نے فرمایا: 'جب تم کھجوریں توڑ لو اور انہیں مربد (کھجوریں خشک کرنے کی جگہ) میں رکھ دو، تو مجھے بلانا۔' جب میں نے کھجوریں توڑ لیں اور انہیں مربد میں رکھ دیا، تو میں رسول اللہ (صلى الله عليه وآله وسلم) کے پاس گیا اور وہ ابو بکر اور عمر کے ساتھ آئے۔ وہ (کھجوروں) پر بیٹھ گئے اور برکت کی دعا کی۔ پھر انہوں نے فرمایا: 'اپنے قرض خواہوں کو بلاؤ اور ان کا قرض چکاؤ۔' میں نے کسی کو نہیں چھوڑا جس کا میرے والد پر کچھ واجب الادا تھا مگر میں نے اس کا قرض ادا کر دیا، اور میرے پاس تیرہ وسق بچ گئے۔ میں نے اس کا ذکر ان سے کیا اور وہ مسکرائے اور فرمایا: 'ابو بکر اور عمر کے پاس جاؤ اور انہیں اس کے بارے میں بتاؤ۔' لہذا میں ابو بکر اور عمر کے پاس گیا اور انہیں اس کے بارے میں بتایا، اور انہوں نے کہا: 'ہم جانتے تھے، جب رسول اللہ (صلى الله عليه وآله وسلم) نے جو کیا، اس کا یہی نتیجہ ہوگا۔'

Riwayat hai ke Jaber bin Abdullah ne kaha: Mere wald qarzdar they. Main ne un ke qarz khawan ko peshkash ki ke woh un ki jagah phal le lein, lekin unhon ne inkar kar diya kyun ke woh samjhte they ke yeh qarz ko pura nahin kare ga. Main Rasool Allah (sallallahu alaihi wa aalihi wa sallam) ke pas gaya aur un ko is bare mein bataya, to unhon ne farmaya: 'Jab tum khajooriyan tod lo aur unhen mubrid (khajooriyan khushk karne ki jagah) mein rakh do, to mujhe bulana.' Jab main ne khajooriyan tod lein aur unhen mubrid mein rakh diya, to main Rasool Allah (sallallahu alaihi wa aalihi wa sallam) ke pas gaya aur woh Abu Bakr aur Umar ke sath aaye. Woh (khajuron) par baith gaye aur barakt ki dua ki. Phir unhon ne farmaya: 'Apne qarz khawan ko bulaon aur un ka qarz chakao.' Main ne kisi ko nahin chhora jis ka mere wald par kuchh wajeb-ul-ada tha magar main ne is ka qarz ada kar diya, aur mere pas terah wasq bach gaye. Main ne is ka zikr un se kiya aur woh muskraye aur farmaya: 'Abu Bakr aur Umar ke pas jaon aur unhen is ke bare mein bataon.' Lahza main Abu Bakr aur Umar ke pas gaya aur unhen is ke bare mein bataya, aur unhon ne kaha: 'Hum jante they, jab Rasool Allah (sallallahu alaihi wa aalihi wa sallam) ne jo kiya, is ka yahi natija hoga.'

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ، قَالَ حَدَّثَنَا عِمْرَانُ بْنُ عُيَيْنَةَ، قَالَ حَدَّثَنَا عَطَاءُ بْنُ السَّائِبِ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، فِي قَوْلِهِ‏{‏إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَى ظُلْمًا‏}‏قَالَ كَانَ يَكُونُ فِي حِجْرِ الرَّجُلِ الْيَتِيمَ فَيَعْزِلُ لَهُ طَعَامَهُ وَشَرَابَهُ وَآنِيَتَهُ فَشَقَّ ذَلِكَ عَلَى الْمُسْلِمِينَ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ ‏{‏وَإِنْ تُخَالِطُوهُمْ فَإِخْوَانُكُمْ‏}‏ ‏{‏فِي الدِّينِ‏}‏ فَأَحَلَّ لَهُمْ خُلْطَتَهُمْ‏.‏
