Hazrat Jabir bin Zaid (R.A) narrates that if a man says to his wife that if I come near you for one year, then you are divorced. Then if he comes near her before the completion of four months, then he will get three divorces. And if he leaves her until four months have passed, then the woman will become ba'in with one divorce and the man can marry her if he wants, but he should not go near her before the completion of the year.
حضرت جابر بن زید (رض) فرماتے ہیں کہ اگر کسی آدمی نے اپنی بیوی سے کہا کہ اگر میں ایک سال تک تیرے قریب آیا تو تجھے طلاق ہے۔ پھر اگر چار مہینے پورے ہونے سے پہلے وہ اس کے قریب آیا تو اسے تین طلاقیں ہوجائیں گی۔ اور اگر اسے چھوڑے رکھایہاں تک کہ چار مہینے گزر گئے تو عورت ایک طلاق کے ساتھ بائنہ ہوجائے گی اور آدمی اگر چاہے تو اس سے نکاح کرلے لیکن سال پورا ہونے سے پہلے اس کے قریب نہ جائے۔
Hazrat Jabir bin Zaid (RA) farmate hain keh agar kisi aadmi ne apni biwi se kaha keh agar mein ek saal tak tere qareeb aaya to tujhe talaq hai. Phir agar chaar maheene poore hone se pehle woh uske qareeb aaya to use teen talaqain hojain gi. Aur agar use chhore rakha yahan tak keh chaar maheene guzar gaye to aurat ek talaq ke sath baina hojae gi aur aadmi agar chahe to us se nikah karle lekin saal poore hone se pehle uske qareeb na jae.
Hazrat Hasan (R.A) said that if he came to her before the completion of four months, she would be considered divorced with three pronouncements. And if he left her until four months had passed, she would be considered divorced with one pronouncement and would be completely separated from him. And if he wished, he could remarry her and could have intercourse with her before the completion of one year.
حضرت حسن (رض) فرماتے ہیں کہ اگر وہ چار مہینے پورے ہونے سے پہلے اس کے پاس آیا تو اسے تین طلاقیں ہوجائیں گی اور اگر اسے چھوڑ دیا یہاں تک کہ چار مہینے گزر گئے تو وہ ایک طلاق کے ساتھ بائنہ ہوجائے گی۔ اور اگر چاہے تو اس سے شادی کرلے اور سال پورا ہونے سے پہلے اس سے جماع کرسکتا ہے۔
Hazrat Hassan (RA) farmate hain ki agar woh char mahine pure hone se pehle uske pass aaya to usay teen talaqen hojayengi aur agar usay chhod diya yahan tak ki char mahine guzar gaye to woh ek talaq ke sath baina hojayegi. Aur agar chahe to us se shadi karle aur saal pura hone se pehle us se jima kar sakta hai.
Hazrat Ibrahim (may Allah be pleased with him) says that if he goes near her before the completion of four months, she will be divorced with three pronouncements. And if he keeps her away for four months, she will become irrevocably divorced with one pronouncement, and he will not be able to marry her until the waiting period of Ila (oath of abstinence), which is less than four months, i.e., two or three months, has passed. Then he can marry her but should not go near her for one year. This was also the opinion of Hazrat Saeed (may Allah be pleased with him).
حضرت ابراہیم (رض) فرماتے ہیں کہ اگر وہ چار مہینے پورے ہونے سے پہلے اس کے قریب آیا تو اسے تین طلاقیں ہوجائیں گی۔ اور اگر چار مہینے تک اسے چھوڑے رکھا تو وہ ایک طلاق کے ساتھ بائنہ ہوجائے گی، اور وہ اس سے اس وقت تک شادی نہیں کرسکتا جب تک ایلاء سے کم دن یعنی دو یاتین مہینے نہ گزر جائیں۔ پھر وہ اس سے شادی کرلے لیکن ایک سال تک اس کے قریب نہ جائے۔ حضرت سعید (رض) کی بھی یہی رائے تھی۔
Hazrat Ibrahim (RA) farmate hain keh agar woh chaar mahine pure hone se pehle uske qareeb aaya to use teen talaaqen hojain gi. Aur agar chaar mahine tak use chhore rakha to woh ek talaaq ke sath baina hojae gi, aur woh us se us waqt tak shadi nahi kar sakta jab tak ilaa se kam din yani do ya teen mahine na guzar jaen. Phir woh us se shadi karle lekin ek saal tak uske qareeb na jae. Hazrat Saeed (RA) ki bhi yahi rae thi.
