Prophet Muhammad (peace be upon him) said about the person who sold something to another person, and then the buyer kept the goods with him and the seller sold it to a third person, "The profit will belong to the first buyer."
حضرت محمد اس شخص کے متعلق فرماتے ہیں جس نے دوسرے کو کچھ فروخت کیا، پھر وہ سامان اسی کے پاس رکھوا دیا اور اس کو مشتری نے آگے فروخت کردیا تو فرمایا منافع پہلے کا ہوگا۔
Hazrat Muhammad iss shakhs ke mutalliq farmate hain jis ne dusre ko kuch farokht kiya phir wo saman usi ke paas rakhwa diya aur usko mushtari ne aage farokht kar diya to farmaya munafa pehle ka hoga
It is narrated from Hadrat Hammad that a person bought goods from another person, then he went to get a carrier to carry them. When he came back, his companion had already sold it to someone else. So, he said that if the same thing is found, then take it from him. And if the second buyer has taken it and now that thing cannot be found, then it will not be permissible for the first buyer. And the profit will belong to the seller. If he finds something like it, he should take it from it, and if he had taken it and he was unable to do so, then there is nothing for him, and the profit will belong to the seller.
حضرت حماد سے مروی ہے کہ ایک شخص نے دوسرے سے سامان خریدا، پھر سامان اٹھانے والے کو لینے چلا گیا تاکہ اس کو منتقل کرے، پھر جب واپس آیا تو اس کا ساتھی اس کو آگے فروخت کرچکا تھا تو فرمایا کہ اگر بعینہٖ وہی چیز مل جائے تو اس سے لے لے۔ اور اگر دوسرا خریدنے والا لے جا چکا ہے اور اب وہ چیز نہیں مل سکتی تو اس پہلے مشتری کے لیے کھ نہیں ہوگا۔ اور نفع بائع کا ہوگا اسی کے مثل چیز پائے تو اس سے وصول کرے، اور اگر وہ لے جا چکا تھا اور اس پر قادر نہ تھا تو اس کے لیے کچھ نہیں ہے، اور منافع فروخت کرنے والے کا ہوگا۔
Hazrat Hammad se marvi hai ki aik shakhs ne dusre se saman khareeda, phir saman uthane wale ko lene chala gaya taake usko muntaqil kare, phir jab wapas aaya to us ka sathi us ko aage farokht kar chuka tha to farmaya ki agar bain hi wohi cheez mil jaye to us se le le. Aur agar dusra kharidne wala le jachaka hai aur ab wo cheez nahi mil sakti to us pehle mushteri ke liye koi haq nahi hoga. Aur nafa ba'e ka hoga isi ke misl cheez paye to us se wasool kare, aur agar wo le jachaka tha aur us par qaadir na tha to us ke liye kuch nahi hai, aur munafa farokht karne wale ka hoga.
Hazrat Mughira narrates that I was present with Hazrat Hukm. He inquired from him about Hazrat Ibrahim. He, however, did not respond.
حضرت مغیرہ فرماتے ہیں کہ میں حضرت حکم کے پاس حاضر تھا حضرت ابراہیم سے انھوں نے اس کے متعلق دریافت کیا تو ان کو جواب نہیں دیا گیا۔
Hazrat Mugheera farmate hain ke main Hazrat Hukm ke paas hazir tha Hazrat Ibrahim se unhon ne iske mutalliq daryaft kiya to unko jawab nahin diya gaya.
