كِتَابُ الْوَصَايَا

Regarding a man who owns houses and bequeaths one-third of them, whether they should be gathered in one place or not

‌فِي رَجُلٍ لَهُ دُورٌ فَأَوْصَى بِثُلُثِهَا، أَيُجْمَعُ لَهُ فِي مَوْضِعٍ أَمْ لَا

Musannaf Ibn Abi Shaybah 30755

Sa'd ibn Ibrahim narrated that I asked Imam Qasim about a man who had some houses and then willed away a third of each house. You said: "The entire portion will be taken out of one place."

سعد بن ابراہم فرماتے ہیں کہ میں نے حضرت قاسم سے اس آدمی کے بارے میں دریافت کیا جس کے کچھ گھر تھے، پھر اس نے ہر گھر کے ایک تہائی کی وصیت کردی، آپ نے فرمایا : اس پورے حصّے کو ایک مکان سے نکال کردیا جائے گا۔

Sad bin Ibrahim farmate hain ki maine Hazrat Qasim se us aadmi ke bare mein daryaft kiya jis ke kuch ghar thay, phir usne har ghar ke ek tihai ki wasiyat kar di, aap ne farmaya: is poore hisse ko ek makan se nikal kar diya jaye ga.

حَدَّثَنَا حَمَّادُ بْنُ خَالِدٍ ، عَنْ عَبْدِ اللَّهِ بْنِ جَعْفَرٍ ، عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ قَالَ : سَأَلْتُ الْقَاسِمَ عَنْ رَجُلٍ كَانَتْ لَهُ مَسَاكِنُ فَأَوْصَى بِثُلُثِ كُلِّ مَسْكَنٍ لَهُ قَالَ : « يُخْرَجُ حَتَّى يَكُونَ فِي مَسْكَنٍ وَاحِدٍ »

Musannaf Ibn Abi Shaybah 30756

It is narrated on the authority of Ata' that a man bequeathed a third of his property and some other items. He left behind a house that was worth a third of his property. It was asked whether the person to whom the bequest was made could be given the house as part of his third. He said: "No, but he should be given a share of both the property and the house."

حضرت عطاء سے اس آدمی کے بارے میں روایت ہے جس نے ایک تہائی مال اور اس کے علاوہ کچھ اشیاء کی وصیت کی ، اور ایک گھر چھوڑ کر مرا جو اس کے مال کا ایک تہائی ہوتا ہے، ان سے پوچھا گیا کیا جس آدمی کے لیے وصیت کی گئی ہے اسے وہ گھر ایک تہائی حصّے میں دیا جاسکتا ہے ؟ انھوں نے فرمایا : نہیں، بلکہ اس کو مال اور گھر دونوں کا ایک حصّہ دیا جائے گا۔

Hazrat Ata se is aadmi ke baare mein riwayat hai jis ne ek tihai maal aur is ke ilawa kuchh ashiya ki wasiyat ki, aur ek ghar chhor kar mara jo is ke maal ka ek tihai hota hai, un se poocha gaya kya jis aadmi ke liye wasiyat ki gayi hai use woh ghar ek tihai hisse mein diya ja sakta hai? Unhon ne farmaya: Nahin, balki is ko maal aur ghar donon ka ek hissa diya jayega.

حَدَّثَنَا يَعْلَى ، عَنْ عَبْدِ الْمَلِكِ ، عَنْ عَطَاءٍ ، فِي رَجُلٍ أَوْصَى بِثُلُثِ مَالِهِ وَأَشْيَاءَ سِوَى ذَلِكَ ، وَتَرَكَ دَارًا يَكُونُ ثُلُثُهَا ، أَيُعْطَاهَا الْمُوصَى لَهُ بِالثُّلُثِ ؟ قَالَ : « لَا وَلَكِنْ يُعْطَى بِالْحِصَّةِ مِنَ الْمَالِ وَالدَّارِ »
