It is narrated on the authority of Yasar bin Abi Karb from Hazrat Shuraih that they had given a verdict concerning a man who had bequeathed an unspecified portion of his property to someone without specifying the amount. You (Hadrat Shuraih) said, "The property should be divided into shares and the person for whom the bequest was made should also be given a share."
یسار بن ابی کرب حضرت شریح سے روایت کرتے ہیں کہ انھوں نے ایک آدمی کے بارے میں فیصلہ کیا تھا جس نے کسی کے لیے اپنے مال کے ایک غیر متعین حصّے کی وصیت کی تھی اور مال کی تحدید نہیں کی تھی، آپ نے فرمایا : مال کے حصّے بنا لیے جائیں اور جس کے لیے وصیت کی گئی ہے اس کو بھی ایک حصّہ دے دیا جائے۔
Yasar bin Abi Karb Hazrat Shariah se riwayat karte hain ke unhon ne ek aadmi ke bare mein faisla kya tha jis ne kisi ke liye apne maal ke ek ghair mutyaien hisse ki wasiyat ki thi aur maal ki tahadeed nahin ki thi, aap ne farmaya: Maal ke hisse bana liye jayen aur jis ke liye wasiyat ki gayi hai us ko bhi ek hissa de diya jaye.
Muhammad bin Saaib narrates that Hazrat Ikrama said about a man who bequeathed a portion of his wealth to someone, that this will not be considered valid because he did not specify the amount.
محمد بن صہیب روایت کرتے ہیں کہ حضرت عکرمہ نے اس آدمی کے بارے میں فرمایا جس نے کسی کے لیے اپنے مال کے ایک حصّے کی وصیت کی کہ اس وصیت کی کوئی وقعت نہیں کیونکہ اس نے مال کی مقدار بیان نہیں کی۔
Muhammad bin Sohaib riwayat karte hain keh Hazrat Akrumah ne is aadmi ke bare mein farmaya jis ne kisi ke liye apne maal ke aik hisse ki wasiyat ki keh is wasiyat ki koi waqyat nahin kyunki us ne maal ki miqdar bayan nahin ki.
It is narrated on the authority of Huzail that a man bequeathed a portion of his wealth to someone without specifying the amount. So, Hazrat Abdullah (R.A.) said that he (the inheritor) is entitled to one-sixth.
ھُزیل سے روایت ہے کہ ایک آدمی نے کسی کے لیے اپنے مال کے ایک حصّے کی وصیت کردی اور مقدار بیان نہیں کی تو حضرت عبداللہ (رض) نے فرمایا اس کے لیے چھٹا حصّہ ہے۔
Huzail se riwayat hai ki aik aadmi ne kisi ke liye apne maal ke aik hisse ki wasiyat kardi aur miqdar bayan nahin ki to Hazrat Abdullah (RA) ne farmaya is ke liye chhata hissa hai.
It is narrated on the authority of Humaid that 'Adi inquired from Hazrat Ayas bin Mu'awiyah about this matter, so he said, "By 'part' is meant one-sixth in the idioms of the Arabs.
حُمید سے روایت ہے کہ عدی نے حضرت ایاس بن معاویہ سے اس بارے میں سوال کیا تو انھوں نے فرمایا ” حصّے “ سے مراد اہل عرب کے محاورات میں چھٹا حصّہ ہوتا ہے۔
Hameed se riwayat hai ki Adi ne Hazrat Ayas bin Muawiya se is baare mein sawal kiya to unhon ne farmaya “Hisse” se murad ahle Arab ke muhaawraat mein chhata hissa hota hai.
