١١-
كِتَابُ الْأَيْمَانِ وَالنُّذُورِ وَالْكَفَّارَاتِ Who said an oath is not binding until he says: By Allah
مَنْ قَالَ لَا يَكُونُ الْقَسَمُ يَمِينًا حَتَّى يَقُولَ: بِاللَّهِ
Musannaf Ibn Abi Shaybah 12333
Hazrat Hassan (may Allah be pleased with him) said that when a person says 'I swear' or 'I bear witness' without mentioning the name of Allah, then there is nothing on him (i.e., he is not bound by his oath).
حضرت حسن فرماتے ہیں کہ جب کوئی شخص یوں کہے میں قسم کھاتا ہوں یا میں گواہی دیتا ہوں اور اللہ کا نام نہ لے تو اس پر کچھ بھی نہیں ہے۔

أَبُو بَكْرِ بْنُ عَيَّاشٍ ، عَنْ هِشَامٍ ، عَنِ الْحَسَنِ ، قَالَ : " إِذَا قَالَ الرَّجُلُ : أَقْسَمْتُ ، أَوْ شَهِدْتُ ، أَوْ حَلَفْتُ ، وَلَمْ يَقُلْ بِاللَّهِ ، فَلَيْسَ بِشَيْءٍ "
