كِتَابُ الْأَيْمَانِ وَالنُّذُورِ وَالْكَفَّارَاتِ

Who said there is no vow in disobedience to Allah, nor in what one does not possess
‌مَنْ قَالَ لَا نَذْرَ فِي مَعْصِيَةِ اللَّهِ، وَلَا فِيمَا لَا يَمْلِكُ

Vows, their expiation, and what they said about it
‌النَّذْرُ مَا كَفَّارَتُهُ وَمَا قَالُوا فِيهِ

Regarding a vow without specifying expiation
‌النَّذْرُ إِذَا لَمْ يُسَمِّ لَهُ كَفَّارَةً

A man vows to fast a day, and that day comes while he is breaking his fast or on Eid
‌الرَّجُلُ يَجْعَلُ عَلَيْهِ نَذْرًا أَنْ يَصُومَ يَوْمًا، فَيَأْتِيَ ذَلِكَ الْيَوْمُ عَلَى فِطْرٍ أَوْ أَضْحَى

Regarding the expiation for an oath, who said half a sa’
‌فِي كَفَّارَةِ الْيَمِينِ، مَنْ قَالَ: نِصْفُ صَاعٍ

Who said the expiation for an oath is a mudd of food
‌مَنْ قَالَ كَفَّارَةُ الْيَمِينِ مُدٌّ مِنْ طَعَامٍ

Who said it suffices to feed them once
‌مَنْ قَالَ: يُجْزِيهِ أَنْ يُطْعِمَهُمْ مَرَّةً وَاحِدَةً

Who said to feed them lunch and dinner
‌مَنْ قَالَ: يُغَدِّيهِمْ، وَيُعَشِّيهِمْ

A woman is as the back of another woman
‌امْرَأَةٌ عَلَيْهِ كَظَهْرِ امْرَأَةِ فُلَانٍ

He says: You are to me as my mother’s belly
‌يَقُولُ: أَنْتِ عَلَيَّ كَبَطْنِ أُمِّي

Regarding a woman fasting in expiation for accidental killing, then menstruating before completing her fast, should she continue or start over
‌فِي الْمَرْأَةِ تَصُومُ فِي كَفَّارَةِ قَتْلٍ خَطَأٍ، ثُمَّ تَحِيضُ، قَبْلَ أَنْ تُتِمَّ صَوْمَهَا تُتِمُّ أَوْ تَسْتَقْبِلُ

Regarding a man swearing by the Quran, what is upon him for that
‌فِي الرَّجُلِ يَحْلِفُ بِالْقُرْآنِ مَاذَا عَلَيْهِ فِي ذَلِكَ

Regarding the lame, the insane, and the one-eyed, whether they suffice in emancipation
‌فِي الْأَعْرَجِ وَالْمَجْنُونِ، وَالْأَعْوَرِ يُجْزِئُ فِي الرَّقَبَةِ

Regarding the child of adultery, whether it suffices in emancipation or not
‌فِي وَلَدِ الزِّنَا يُجْزِئُ فِي الرَّقَبَةِ، أَمْ لَا

Does a disbeliever suffice for expiation
‌الْكَافِرُ يُجْزِئُ مِنَ الْكَفَّارَةِ

Regarding the emancipation of a slave who is promised freedom after the master’s death, in expiations
‌فِي عِتْقِ الْمُدَبَّرِ فِي الْكَفَّارَاتِ

Regarding the mother of the child, does she suffice for expiation or not
‌فِي أُمِّ الْوَلَدِ تُجْزِئُ فِي الْكَفَّارَةِ أَمْ لَا

Regarding emancipation through a written agreement, does it suffice or does her child
‌فِي الْمُكَاتَبَةِ تُجْزِئُ أَوْ وَلَدُهَا

Regarding someone who injures a fetus, who said it requires freeing a slave along with the compensation
‌الَّذِي يُصِيبُ الْجَنِينَ مَنْ قَالَ: عَلَيْهِ عِتْقُ رَقَبَةٍ مَعَ الْغُرَّةِ

Regarding the expiation of zihar, feeding sixty poor people, ten repeatedly
‌فِي كَفَّارَةِ الظِّهَارِ يُطْعِمُ سِتِّينَ مِسْكِينًا عَشَرَةً يُكَرِّرُ عَلَيْهِمِ الْإِطْعَامَ

Regarding a man swearing by something other than Allah or by his father
‌الرَّجُلُ يَحْلِفُ بِغَيْرِ اللَّهِ أَوْ بِأَبِيهِ

Regarding a man saying: By my life, is there anything upon him
‌الرَّجُلِ يَقُولُ: لَعَمْرِي عَلَيْهِ شَيْءٌ

Regarding a man saying: I swore but did not swear
‌فِي الرَّجُلِ يَقُولُ: حَلَفْتُ وَلَمْ يَحْلِفْ

Who said expiation is after breaking the oath
‌مَنْ قَالَ: الْكَفَّارَةُ بَعْدَ الْحِنْثِ

Who permitted expiation before breaking the oath
‌مَنْ رَخَّصَ أَنْ يُكَفِّرَ قَبْلَ أَنْ يَحْنَثَ

Regarding oaths that are not expiated and their differences
‌فِي الْأَيْمَانِ الَّتِي لَا تُكَفَّرُ وَاخْتِلَافُهُمْ فِي ذَلِكَ

Who said an oath is a binding oath that requires expiation
‌مَنْ قَالَ الْقَسَمُ يَمِينٌ يُكَفَّرُ

Who said an oath is not binding until he says: By Allah
‌مَنْ قَالَ لَا يَكُونُ الْقَسَمُ يَمِينًا حَتَّى يَقُولَ: بِاللَّهِ

Who said: I swear or I swear by Allah, and for Allah I have a vow, both are the same
‌مَنْ قَالَ: أُقْسِمُ أَوْ أُقْسِمُ بِاللَّهِ وَلِلَّهِ عَلَيَّ نَذْرٌ سَوَاءٌ

Regarding a man repeating oaths on the same matter
‌فِي الرَّجُلِ يُرَدِّدُ الْأَيْمَانَ فِي الشَّيْءِ الْوَاحِدِ

What they said about a man gifting his wealth or his slave
‌مَا قَالُوا فِي الرَّجُلِ يُهْدِي مَالَهُ أَوْ غُلَامَهُ

What is gifted to the house, what should be done with it
‌مَا يُهْدَى إِلَى الْبَيْتِ مَا يُصْنَعُ بِهِ

Who disliked gifts to the house and preferred charity instead
‌مَنْ كَرِهَ الْهَدْيَ إِلَى الْبَيْتِ وَاخْتَارَ الصَّدَقَةَ عَلَى ذَلِكَ

Regarding fasting three days for expiation of an oath, whether they should be separated or not
‌فِي الصِّيَامِ ثَلَاثَةِ أَيَّامٍ فِي كَفَّارَةِ الْيَمِينِ يُفَرَّقُ بَيْنَهَا أَمْ لَا

Regarding having intercourse with a woman while she is menstruating, what is upon him
‌يَقَعُ عَلَى الْمَرْأَةِ وَهِيَ حَائِضٌ، مَا عَلَيْهِ

Regarding a man swearing not to maintain kinship ties, what should he do
‌فِي الرَّجُلِ يَحْلِفُ لَا يَصِلُ رَحِمَهُ مَا يُؤْمَرُ بِهِ

Regarding a man having intercourse with his wife while she is making up Ramadan
‌فِي الرَّجُلِ يَقَعُ عَلَى امْرَأَتِهِ تَقْضِي شَهْرَ رَمَضَانَ

Regarding a man being sworn by the ruler to inform him of another man's wealth
‌فِي الرَّجُلِ يُحَلِّفُهُ السُّلْطَانُ أَنْ يُخْبِرَهُ بِمَالِ رَجُلٍ

Regarding a man swearing to beat his slave, what suffices for that
‌فِي الرَّجُلِ يَحْلِفُ لَيَضْرِبَنَّ غُلَامَهُ مَا يُجْزِيهِ مِنْ ذَلِكَ

Regarding a man fasting for zihar, then having intercourse
‌فِي رَجُلٍ صَامَ فِي ظِهَارٍ، ثُمَّ جَامَعَ

Regarding a man swearing by Ihram, what is the expiation for that
‌فِي الرَّجُلِ يَحْلِفُ بِالْإِحْرَامِ مَا كَفَّارَةُ ذَلِكَ

Regarding a man saying: I will surely come to you, by Allah wherever you are
‌فِي الرَّجُلِ يَقُولُ: وَإِنِّي سَآتِيكَ، وَاللَّهِ حَيْثُ كَانَ

He vowed to restrain his nose, what is his expiation
‌نَذَرَ أَنْ يَزُمَّ أَنْفَهُ مَا كَفَّارَتُهُ

Regarding a man and a woman swearing to walk but unable to do so
‌الرَّجُلُ وَالْمَرْأَةُ يَحْلِفَانِ بِالْمَشْيِ وَلَا يَسْتَطِيعَانِ

A man saying: I vow to walk to the house, but does not say: I vow to walk to the House of Allah, or to the Kaaba, does it bind him
‌الرَّجُلُ يَقُولُ: عَلَيَّ الْمَشْيُ إِلَى الْبَيْتِ، وَلَا يَقُولُ: عَلَيَّ نَذْرُ مَشْيٍ إِلَى بَيْتِ اللَّهِ، أَوْ إِلَى الْكَعْبَةِ، هَلْ يَلْزَمُهُ ذَلِكَ

Regarding a man vowing while he was a polytheist, then he became Muslim, what they said about him
‌فِي رَجُلٍ نَذَرَ وَهُوَ مُشْرِكٌ، ثُمَّ أَسْلَمَ مَا قَالُوا فِيهِ

Who forbade vows and disliked them
‌مَنْ نَهَى عَنِ النَّذْرِ وَكَرِهَهُ

A Muslim accidentally kills a non-Muslim under protection
‌الْمُسْلِمُ يَقْتُلُ الذِّمِّيَّ خَطَأً

Regarding a woman accidentally killing and not having a guardian to expiate for her
‌فِي الْمَرْأَةِ تَقْتُلُ خَطَأً، وَلَيْسَ لَهَا وَلِيٌّ يُكَفِّرُهَا

Regarding a man accidentally killing and fasting, does it suffice instead of freeing a slave
‌فِي الرَّجُلِ يَقْتُلُ خَطَأً فَيَصُومُ هَلْ يُجْزِيهِ مِنْ عِتْقِ الرَّقَبَةِ

Regarding a man vowing to sacrifice at a place, pray there, or walk to it
‌فِي الرَّجُلِ يَجْعَلُ عَلَيْهِ النَّذْرَ إِلَى الْمَوْضِعِ، فَيُنْحَرُ فِيهِ، أَوْ يُصَلِّي، أَوْ يُمْشَى إِلَيْهِ

A man or woman who has to sacrifice a cow, can they sell its skin
‌الرَّجُلُ أَوِ الْمَرْأَةُ يَكُونُ عَلَيْهِ أَنْ يَنْحَرَ بَقَرَةً، لَهُ أَنْ يَبِيعَ جِلْدَهَا

Regarding a man vowing to sacrifice a camel or a cow
‌فِي الرَّجُلِ يَجْعَلُ عَلَيْهِ نَذْرًا أَنْ يَنْحَرَ بَدَنَةً أَوْ يَنْحَرَ بَقَرَةً

Having intercourse during I'tikaf, what is upon him
‌يُجَامِعُ فِي اعْتِكَافِهِ مَا عَلَيْهِ فِي ذَلِكَ

Regarding two men conspiring to kill another man
‌فِي الرَّجُلَيْنِ يَجْتَمِعَانِ عَلَى قَتْلِ رَجُلٍ

Regarding a man vowing to free a descendant of Isma'il
‌فِي الرَّجُلِ يَجْعَلُ عَلَيْهِ رَقَبَةً مِنْ وَلَدِ إِسْمَاعِيلَ
57
A man swearing not to speak to another man for a period, how long is that
‌الرَّجُلُ يَحْلِفُ أَنْ لَا يُكَلِّمَ الرَّجُلَ حِينًا كَمْ يَكُونُ ذَلِكَ

How they used to swear
‌كَيْفَ مَا كَانُوا يَحْلِفُونَ

Regarding a man vowing not to approach his wife
‌فِي الرَّجُلِ يُؤْلِي مِنِ امْرَأَتِهِ وَلَا يَقْرَبُهَا

Who said there is expiation for it and nothing upon him
‌مَنْ قَالَ: فِيهِ كَفَّارَةٌ وَلَا شَيْءَ عَلَيْهِ

Regarding a man vowing to fast for a month
‌فِي رَجُلٍ جَعَلَ عَلَيْهِ صَوْمَ شَهْرٍ

A man obligated to expiate for an oath or other, can he feed one poor person repeatedly
‌الرَّجُلُ يَجِبُ عَلَيْهِ كَفَّارَةٌ فِي يَمِينٍ أَوْ غَيْرِهِ أَيُطْعِمُ مِسْكِينًا وَاحِدًا يُرَدِّدُ عَلَيْهِ

Not finding a Muslim poor person, can he give his expiation to Jews and Christians
‌لَا يَجِدُ مِسْكِينًا مُسْلِمًا فَيُعْطِي كَفَّارَتَهُ الْيَهُودَ، وَالنَّصَارَى

Swearing and breaking the oath while having something small
‌يَحْلِفُ فَيَحْنَثُ وَعِنْدَهُ شَيْءٌ يَسِيرٌ

Who swore not to drink milk, can he eat butter or cheese, or who swore not to eat meat, can he eat fat
‌مَنْ حَلَفَ لَا يَشْرَبُ لَبَنًا أَيَأْكُلُ زُبْدًا أَوْ جُبْنًا، أَوْ لَا يَأْكُلُ لَحْمًا أَيَأْكُلُ شَحْمًا

Who swore not to eat meat, can he eat soft fat
‌مَنْ حَلَفَ أَنْ لَا يَأْكُلَ لَحْمًا أَيَأْكُلُ شَحْمًا طَرِيًّا

Regarding a man saying he will sacrifice his son
‌فِي الرَّجُلِ يَقُولُ هُوَ يَنْحَرُ ابْنَهُ

A man says to another man: I will gift you
‌الرَّجُلُ يَقُولُ لِلرَّجُلِ: أَنَا أُهْدِيكَ

‌فِي مُظَاهِرٍ يَتَهَاوَنُ بِالْكَفَّارَةِ

Regarding a woman who vowed to pray in fifty mosques
‌فِي امْرَأَةٍ نَذَرَتْ أَنْ تُصَلِّي فِي خَمْسِينَ مَسْجِدًا

Who permitted the emancipation of a child born out of wedlock
‌مَنْ رَخَّصَ فِي عِتْقِ وَلَدِ الزِّنَا

Saying: Who is he who guides him on the edges of his eyes
‌يَقُولُ: مَنْ هُوَ يُهْدِيهِ عَلَى أَشْفَارِ عَيْنَيْهِ

She swore and gifted what was for her servant's baldness
‌حَلَفَتْ فَأَهْدَتْ مَا لِصَلَعِ خَادِمِهَا

Regarding a man breaking his fast during the days of Ramadan
‌فِي الرَّجُلِ يُفْطِرُ أَيَّامًا مِنْ رَمَضَانَ

Who breaks his fast for a day in Ramadan
‌مَنْ يُفْطِرُ يَوْمًا مِنْ رَمَضَانَ

Saying: Upon me is the sacrificial offering
‌يَقُولُ: عَلَيَّ الْهَدْيُ

‌فِي امْرَأَةٌ نَذَرَتْ أَنْ تَعْتَكِفَ فِي مَسْجِدٍ فَمُنِعَتْ

‌فِي الرَّجُلِ يُسْتَحْلَفُ فَيَنْوِي بِالشَّيْءِ

‌فِي الرَّجُلِ يَقُولُ: لَمْ أَحْلِفْ

‌الرَّجُلُ يَحْلِفُ أَنْ لَا يَفْعَلَ فَيُكْرَهُ

‌مَنْ مَاتَ وَعَلَيْهِ نَذْرٌ

‌فِي الرَّجُلِ يَحْلِفُ عَلَى مَالِ الرَّجُلِ

‌فِي كَفَّارَةِ الظِّهَارِ مَتَى هِيَ

Who has no binding oath upon the one he swore against
‌مَنْ لَا يَمِينَ لَهُ عَلَى مَنْ حَلَفَ عَلَيْهِ

‌الْمُظَاهِرُ عَنْ أَمَتِهِ أَيُعْتِقُهَا

Regarding a man who forbids in anger
‌فِي الرَّجُلِ يُحَرِّمُ فِي الْغَضَبِ

Regarding a man who slaps his servant
‌فِي الرَّجُلِ يَلْطِمُ خَادِمَهُ

Regarding the prohibition of swearing
‌فِي النَّهْيِ عَنِ الْحَلِفِ

Who said: Upon me is the wrath of Allah
‌مَنْ قَالَ: عَلَيَّ غَضَبُ اللَّهِ

Who said: May Allah break my back
‌مَنْ قَالَ: قَطَعَ اللَّهُ ظَهْرِي

Who had intercourse with his wife in Ramadan and ate
‌مَنْ غَشِيَ امْرَأَتَهُ فِي رَمَضَانَ وَأَكَلَ

The one performing zihar, if he fulfills, does he expiate or not
‌الْمُظَاهِرُ إِذَا بَرَّ يُكَفِّرُ أَمْ لَا

Regarding a man swearing about food
‌فِي الرَّجُلِ يَحْلِفُ عَلَى الطَّعَامِ

A woman who vowed to circumambulate on all fours
‌امْرَأَةٌ نَذَرَتْ أَنْ تَطُوفَ عَلَى أَرْبَعِ قَوَائِمَ

Regarding a woman who swore by emancipating her slave girl not to speak to her neighbor, but the slave girl died
‌فِي امْرَأَةٍ حَلَفَتْ بِعِتْقِ جَارِيَتِهَا أَلَا تُكَلِّمَ جَارَتَهَا فَمَاتَتِ الْجَارِيَةُ

‌فِي الرَّجُلِ يَقُولُ: أَلْقَانِي اللَّهُ فِي النَّارِ
