Book of Divorce
١٤-
كِتَابُ الطَّلَاقِ
Concerning the man who has two wives, forbids one of them from going out, but the other one goes out, and he says: So-and-so went out, you are divorced.
فِي الرَّجُلِ تَكُونُ لَهُ امْرَأَتَانِ، نَهَى إِحْدَاهُمَا عَنِ الْخُرُوجِ، فَخَرَجَتِ الَّتِي لَمْ تُنْهَ، فَقَالَ: فُلَانَةُ خَرَجَتْ أَنْتِ طَالِقٌ

Hazrat Ata (may Allah be pleased with him) said: If a man forbids his wife from going out, then another wife of his goes out and someone says to him, "That was your wife." He understood this to mean that maybe it was the one he had forbidden, and divorced her with the intention of divorce, then divorce will not take place.
حضرت عطائ (رض) فرماتے ہیں کہ اگر ایک آدمی نے اپنی بیوی کو قسم دی کہ وہ باہر نہیں نکلے گی۔ لیکن اس کی کوئی دوسری بیوی باہر نکلی، اسے کسی نے کہا کہ وہ تیری بیوی ہے۔ وہ یہ سمجھا کہ شاید یہ وہ ہے جسے نکلنے سے منع کیا تھا اور اس نے اسے طلاق دے دی تو طلاق نہیں ہوگی۔
Hazrat Ata (RA) farmate hain keh agar aik aadmi ne apni biwi ko qasam di keh woh bahar nahi niklegi lekin uski koi dusri biwi bahar nikli use kisi ne kaha keh woh teri biwi hai woh yeh samjha keh shayad yeh woh hai jise nikalne se mana kiya tha aur usne use talaq de di to talaq nahi hogi
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : نا عُمَرُ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَطَاءٍ ، قَالَ : سَمِعْتُهُ يَقُولُ : " إِنْ حَلَفَ رَجُلٌ عَلَى امْرَأَتِهِ أَنَّهَا لَا تَخْرُجُ فَخَرَجَتِ امْرَأَةٌ لَهُ أُخْرَى فَقِيلَ لَهُ : هَذِهِ امْرَأَتُكَ فَحَسِبَهَا الْأُخْرَى فَطَلَّقَهَا قَالَ عَطَاءٌ : « لَيْسَ بِشَيْءٍ »
