كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
Who said: The profit is according to what they agreed upon, and the loss is on the principal amount
مَنْ قَالَ: الرِّبْحُ عَلَى مَا اصْطَلَحَا عَلَيْهِ وَالْوَضِيعَةُ عَلَى رَأْسِ الْمَالِ

Hazrat Shuba said, "I asked Hazrat Hukam, Hazrat Hammad, and Hazrat Qatadah about two men who partnered in business. One invested two thousand and the other invested one thousand. They agreed that the loss would be shared between them, and the profit would be divided equally between them. What is the ruling on this?" They said, "The profit will be distributed according to the agreed-upon condition, and the loss will be borne from the principal amounts."
حضرت شعبہ فرماتے ہیں کہ میں نے حضرت حکم، حضرت حماد اور حضرت قتادہ سے سوال کیا کہ اگر دو آدمیوں نے باہم شراکت پر کام کیا، ایک دو ہزار اور دوسرا ایک ہزار لایا۔ انھوں نے یہ شرط لگائی کہ نقصان دونوں کے درمیان ہوگا اور نفع بھی دونوں کو آدھا آدھا ملے گا۔ اس کا کیا حکم ہے ؟ انھوں نے فرمایا کہ نفع طے کردہ شرط کے مطابق ہوگا اور نقصان اصل مال میں سے پورا کیا جائے گا۔
Hazrat Shoba farmate hain ke maine Hazrat Hukm, Hazrat Hammad aur Hazrat Qatada se sawal kiya ke agar do aadmiyon ne baham sharaakat par kaam kiya, ek do hazaar aur doosra ek hazaar laya. Unhon ne ye shart lagayi ke nuqsaan dono ke darmiyaan hoga aur nafa bhi dono ko aadha aadha milega. Is ka kya hukum hai? Unhon ne farmaya ke nafa taye kardah shart ke mutabiq hoga aur nuqsaan asal maal mein se poora kiya jayega.
نَا عَبْدُ الصَّمَدِ بْنُ عَبْدِ الْوَارِثِ ، عَنْ شُعْبَةَ ، قَالَ : سَأَلْتُ الْحَكَمَ وَحَمَّادًا وَقَتَادَةَ عَنْ رَجُلَيْنِ ، اشْتَرَكَا فَجَاءَ أَحَدُهُمَا بِأَلْفَيْنِ ، وَجَاءَ الْآخَرُ بِأَلْفٍ ، فَاشْتَرَكَا وَاشْتَرَطَا أَنَّ الْوَضِيعَةَ بَيْنَهُمَا ، وَالرِّبْحَ نِصْفَانِ ، فَقَالَ : « الرِّبْحُ عَلَى مَا اشْتَرَطَا عَلَيْهِ ، وَالْوَضِيعَةُ عَلَى الْمَالِ »
