كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
On a pledger and pledgee having a dispute
فِي الرَّاهِنِ وَالْمُرْتَهِنِ يَخْتَلِفَانِ
Musannaf Ibn Abi Shaybah 20298
Hazrat Qatada said that when there is a difference between a narrator and a deceased narrator, then the statement of the deceased narrator will be considered authentic. If there is a difference in the price of a valuable item, then the narrator's statement will be considered authentic.
حضرت قتادہ فرماتے ہیں کہ جب راہن اور مرتہن کا اختلاف ہوجائے تو پھر مرتہن کا قول معتبر ہوگا، اگر قیمت والی چیز میں اضافے کا اختلاف ہو تو راہن کا قول معتبر ہوگا۔
Hazrat Qatadah farmate hain ke jab rahin aur murtahin ka ikhtilaf hojae to phir murtahin ka qaul motabar hoga, agar qeemat wali cheez mein izafay ka ikhtilaf ho to rahin ka qaul motabar hoga.
نَا زَيْدُ بْنُ الْحُبَابِ ، عَنْ حَمَّادِ بْنِ سَلَمَةَ ، عَنْ إِيَاسِ بْنِ مُعَاوِيَةَ ، قَالَ : « إِذَا اخْتَلَفَ الرَّاهِنُ وَالْمُرْتَهِنُ فَالْقَوْلُ قَوْلُ الْمُرْتَهِنِ مَا بَيْنَهُ وَبَيْنَ قِيمَتِهِ ، فَإِذَا زَادَتْ فَالْقَوْلُ قَوْلُ الرَّاهِنِ »
