كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ On two men disputing, one claiming something against the other, who should take the oath
فِي الرَّجُلَيْنِ يَخْتَصِمَانِ فَيَدَّعِي أَحَدُهُمَا عَلَى الْآخَرِ الشَّيْءَ، عَلَى مَنْ تَكُونُ الْيَمِينُ

Hazrat Saeed bin Musayyab said that the Sunnah is to swear by the one being testified about.
حضرت سعید بن مسیب فرماتے ہیں کہ سنت یہ رہی ہے کہ قسم مدعی علیہ پر ہے۔
Hazrat Saeed bin Musayyab farmate hain keh sunnat yeh rahi hai keh qasam muddai alaihai par hai.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ ، عَنْ زَمْعَةَ ، عَنِ الزُّهْرِيِّ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : « مَضَتِ السُّنَّةُ أَنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ »
