كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
A slave shared between two men, and one of them frees him, to whom does the loyalty (wala') belong?
الْعَبْدُ بَيْنَ رَجُلَيْنِ يُعْتِقُهُ أَحَدُهُمَا لِمَنْ يَكُونُ الْوَلَاءُ

Hazrat Hassan (R.A) said that if a person who is set free has a rich master, then the master will be responsible for paying the price of freedom to the partner and the master will have the Wila of the slave. And if the master is poor then the freed slave himself will strive (for the rest of the amount) and the Wila will belong to both of them.
حضرت حسن (رض) فرماتے ہیں کہ آزاد کرنے والا مالک اگر مالدار ہے تو ساتھی کے لیے قیمت کا ضامن ہوگا اور غلام کی ولاء اسی کو ملے گی۔ اور اگر وہ غریب ہے تو غلام خود کوشش کرے گا ( بقیہ قیمت کی ) اور ولاء ان دونوں کو ملے گی۔
Hazrat Hassan (RA) farmate hain ke azad karne wala malik agar maldar hai to sathi ke liye keemat ka zaman hoga aur ghulam ki wala isi ko milegi. Aur agar wo gareeb hai to ghulam khud koshish karega (baqia keemat ki) aur wala in donon ko milegi.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا حَفْصٌ ، عَنْ أَشْعَثَ ، عَنِ الْحَسَنِ ، قَالَ : « إِنْ كَانَ مُوسِرًا ضَمِنَ ، وَكَانَ الْوَلَاءُ لَهُ ، وَإِنْ كَانَ مُعْسِرًا سَعَى الْعَبْدُ ، وَكَانَ الْوَلَاءُ بَيْنَهُمَا »
