كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ Regarding the verse: 'And the witnesses should not refuse when they are summoned.'
فِي قَوْلِهِ: ﴿وَلَا يَأْبَ الشُّهَدَاءُ إِذَا مَا دُعُوا﴾ [

Hazrat Shabi (R.A) said that as long as a witness has not testified, he has the option (to testify or not).
حضرت شعبی (رض) فرماتے ہیں کہ جب تک گواہ نے گواہی نہیں دی اس کو اختیار ہے۔
Hazrat Shabi (RA) farmate hain ke jab tak gawah ne gawahi nahi di us ko ikhtiyar hai.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا وَكِيعٌ ، قَالَ : حَدَّثَنَا سُفْيَانُ ، عَنْ جَابِرٍ ، عَنِ الشَّعْبِيُّ ، قَالَ : « الشَّاهِدُ بِالْخِيَارِ مَا لَمْ يَشْهَدْ »
