كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ Regarding a man who gives his mother a slave girl as charity.
فِي الرَّحْلِ يَتَصَدَّقُ عَلَى أُمِّهِ بِجَارِيَةٍ
Musannaf Ibn Abi Shaybah 23329
Prophet Abraham declared the slave girl to be the property of his mother, provided that he brings a witness to testify that he had given her as a gift (dowry) before.
حضرت ابراہیم نے باندی کو والدہ کی ملکیت قرار دیا مگر یہ کہ وہ اس پر گواہ لے آئے کہ اس نے صدقہ (ہبہ) کرنے سے قبل مہر میں دیا تھا۔
Hazrat Ibrahim nay bandi ko walida ki malkiat qarar diya magar ye keh woh iss par gawah le aaye keh uss nay sadqa (hiba) karne se qabal mehr mein diya tha.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا جَرِيرٌ ، عَنْ مُغِيرَةَ ، عَنْ إِبْرَاهِيمَ : « أَنَّهُ كَانَ يَجْعَلُهَا لِأُمِّهِ إِلَّا أَنْ يُبَيِّنَهُ أَنَّهُ أَصْدَقَهَا قَبْلَ أَنْ تَصَّدَّقَ بِهَا عَلَيْهِ »
