كِتَابُ الدِّيَاتِ
Intentional harm where retribution is not possible.
الْعَمْدُ الَّذِي لَا يُسْتَطَاعُ فِيهِ الْقِصَاصُ
Musannaf Ibn Abi Shaybah 27413
Hazrat Mughira narrated that Hazrat Abraham said: "If a wound is inflicted intentionally and it is not possible to take retaliation for it, then its compensation will be obligatory on the wealth of the one who inflicted the wound, not on his family."
حضرت مغیرہ فرماتے ہیں کہ حضرت ابراہیم نے ارشاد فرمایا : جو زخم قصداً لگایا ہو اور اس میں قصاص لینا ممکن نہ ہو تو اس کا ضمان زخم لگانے والے کے مال میں لازم ہوگا نہ کہ اس کے خاندان والوں پر۔
Hazrat Mugheera farmate hain ke Hazrat Ibrahim ne irshad farmaya: Jo zakhm qasdan lagaya ho aur us mein qisas lena mumkin na ho to us ka zaman zakhm lagane wale ke maal mein lazim hoga na ke us ke khandan walon par.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا جَرِيرٌ ، عَنْ مُغِيرَةَ ، عَنْ إِبْرَاهِيمَ ، قَالَ : « مَا كَانَ مِنْ جُرْحٍ مِنَ الْعَمْدِ لَا يُسْتَطَاعُ فِيهِ الْقِصَاصُ ، فَهُوَ عَلَى الْجَارِحِ فِي مَالِهِ دُونَ عَاقِلَتِهِ »
