كِتَابُ الدِّيَاتِ
What has been said about the oath of accusation.
مَا جَاءَ فِي الْقَسَامَةِ

Hazrat Yunus narrates that Hazrat Hasan Basri said about the person who is murdered deceptively that fifty people from the accusers should take fifty oaths in this manner that neither we have killed him nor do we know the killer. So if they take the oath, then they will be free from liability. And if they refuse to take the oath then fifty people from the claimants should take the oath that his blood is on you, meaning you are responsible. Then the blood money will be paid.
حضرت یونس فرماتے ہیں کہ حضرت حسن بصری نے دھوکا سے قتل ہونے والے مقتول کے بارے میں یوں ارشاد فرمایا کہ مدعی علیھم میں سے پچاس آدمی یوں پچاس قسمیں اٹھائیں گے کہ نہ ہم نے قتل کیا ہے اور نہ ہمیں قاتل معلوم ہے پس اگر انھوں نے قسم اٹھالی تو وہ بری ہوجائں گے اور اگر انھوں نے قسم اٹھانے سے انکار کردیا تو مدعیوں میں سے پچاس لوگ قسم اٹھائیں گے کہ ہمارا خون تمہاری طرف سے ہوا ہے پھر دیت ادا کی جائے گی۔
Hazrat Younis farmate hain keh Hazrat Hassan Basri ne dhoka se qatal hone wale maqtool ke bare mein youn irshad farmaya keh mudai alaihim mein se pachas aadmi youn pachas qasmen uthayen ge keh na hum ne qatal kiya hai aur na humein qatil maloom hai pas agar unhon ne qasam utha li to woh bari hojayen ge aur agar unhon ne qasam uthane se inkar kardiya to mudaiyon mein se pachas log qasam uthayen ge keh hamara khoon tumhari taraf se hua hai phir deet ada ki jaye gi.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا عَبْدُ الْأَعْلَى ، عَنْ يُونُسَ ، عَنِ الْحَسَنِ ، فِي الْقَتِيلِ يُوجَدُ غِيلَةً ، قَالَ : « يَقْسِمُ مِنَ الْمُدَّعَى عَلَيْهِمْ خَمْسُونَ يَمِينًا مَا قَتَلْنَا وَلَا عَلِمْنَا قَاتِلًا ، فَإِنْ حَلَفُوا فَقَدْ بَرِئُوا ، وَإِنْ نَكَلُوا أَقْسَمَ مِنَ الْمُدَّعِينَ خَمْسُونَ إِنَّ دَمَنَا قِبَلَكُمْ ، ثُمَّ يُودُوا »
