Musannaf Ibn Abi Shaybah 27818
Hazrat Bashir bin Yasar, an Ansar whose name was Sahl bin Abu Hatma, narrates: A group of his people went to Khaybar. When they reached there and dispersed, they found one of their companions dead. They said to those with whom they found him dead, "You have killed our companion!" They replied, "We have not killed him, nor do we know who the killer is." So, these people came to the Prophet (peace and blessings of Allah be upon him) and said, "O Messenger of Allah! We went to Khaybar, and we found one of our companions dead there." The Messenger of Allah (peace and blessings of Allah be upon him) said, "Call the elder, call the elder." Then you (peace and blessings of Allah be upon him) said to them, "Bring forth witnesses against the one who killed him." They said, "We do not have any witnesses." You (peace and blessings of Allah be upon him) said, "Then let the Jews swear an oath for you." They said, "We do not accept the oath of the Jews." So, the Prophet of Allah (peace and blessings of Allah be upon him) disliked that his blood should be wasted, and you (peace and blessings of Allah be upon him) paid his blood money, one hundred camels, from the camels of charity.
حضرت بشیر بن یسار ایک انصاری شخص جس کا نام سہل بن ابو حثمہ تھا وہ فرماتے ہیں کہ ان کی قوم کی ایک جماعت خیبر کی طرف گئی، وہ وہاں جا کر منتشر ہوگئے پھر انھوں نے اپنے ایک ساتھی کو مردہ حالت میں پایا ۔ انھوں نے جن کے پاس اسے مردہ حالت میں پایا تھا ان سے وہ کہنے لگے تم نے ہمارے ساتھی کو قتل کردیا انھوں نے کہا : ہم نے قتل نہیں کیا اور نہ ہی ہمیں قاتل کا علم ہے پھر یہ لوگ اللہ کے نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آگئے اور کہنے لگے، یا نبی اللہ ! ہم خیبر گئے تھے تو وہاں ہم نے اپنے ایک ساتھی کو مرا ہوا پایا۔ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : بڑے کو بلاؤ بڑے کو بلاؤ پھر آپ (صلی اللہ علیہ وآلہ وسلم) نے ا ن سے فرمایا : تم لوگ اس شخص کے خلاف گواہی لاؤ جس نے قتل کیا ہے انھوں نے کہا ہمارے پاس گواہ تو نہیں ہیں آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : پھر یہودی تمہارے لیے قسم اٹھائیں گے انھوں نے کہا : ہم یہود کی قسم سے راضی نہیں ہوں گے پس اللہ کے نبی نے اس کے خون کے رائیگاں جانے کو ناپسند سمجھا اور آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کی دیت سو اونٹ ادا کی صدقہ کے اونٹوں میں سے۔
Hazrat Bashir bin Yasar aik Ansari shakhs jis ka naam Sahl bin Abu Hatma tha woh farmate hain ke un ki qaum ki aik jamaat Khyber ki taraf gayi woh wahan ja kar muntashir ho gaye phir unhon ne apne aik sathi ko murda halat mein paya unhon ne jin ke paas ise murda halat mein paya tha un se woh kahne lage tum ne hamare sathi ko qatal kar diya unhon ne kaha hum ne qatal nahi kiya aur na hi humein qatil ka ilm hai phir yeh log Allah ke Nabi (Sallallahu Alaihi Wasallam) ke paas aaye aur kahne lage Ya Nabi Allah hum Khyber gaye the to wahan hum ne apne aik sathi ko mara hua paya Rasool Allah (Sallallahu Alaihi Wasallam) ne farmaya bade ko bulao bade ko bulao phir Aap (Sallallahu Alaihi Wasallam) ne un se farmaya tum log is shakhs ke khilaf gawahi lao jis ne qatal kiya hai unhon ne kaha hamare paas gawah to nahi hain Aap (Sallallahu Alaihi Wasallam) ne farmaya phir yahoodi tumhare liye qasam uthayenge unhon ne kaha hum yahood ki qasam se razi nahi honge pas Allah ke Nabi ne is ke khoon ke raegan jane ko napasand samjha aur Aap (Sallallahu Alaihi Wasallam) ne is ki deet so unt ada ki sadqa ke unton mein se
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا الْفَضْلُ بْنُ دُكَيْنٍ ، عَنْ سَعِيدِ بْنِ عُبَيْدٍ ، عَنْ بُشَيْرِ بْنِ يَسَارٍ ، زَعَمَ أَنَّ رَجُلًا مِنَ الْأَنْصَارِ يُقَالُ لَهُ سَهْلُ بْنُ أَبِي حَثْمَةَ أَخْبَرَهُ أَنَّ نَفَرًا مِنْ قَوْمِهِ انْطَلَقُوا إِلَى خَيْبَرَ فَتَفَرَّقُوا فِيهَا ، فَوَجَدُوا أَحَدَهُمْ قَتِيلًا ، فَقَالُوا لِلَّذِينَ وَجَدُوهُ عِنْدَهُمْ : قَتَلْتُمْ صَاحِبَنَا ، قَالُوا : مَا قَتَلْنَا وَلَا عَلِمْنَا ، فَانْطَلَقُوا إِلَى نَبِيِّ اللَّهِ ﷺ ، فَقَالُوا : يَا نَبِيَّ اللَّهِ انْطَلَقْنَا إِلَى خَيْبَرَ فَوَجَدْنَا أَحَدَنَا قَتِيلًا ، قَالَ رَسُولُ اللَّهِ ﷺ : « الْكُبْرَ الْكُبْرَ » فَقَالَ لَهُمْ : « تَأْتُونَ بِالْبَيِّنَةِ عَلَى مَنْ قَتَلَ » فَقَالُوا : مَا لَنَا بَيِّنَةٌ ، قَالَ : « فَيَحْلِفُونَ لَكُمْ » قَالُوا : لَا نَرْضَى بِأَيْمَانِ الْيَهُودِ ، فَكَرِهَ نَبِيُّ اللَّهِ ﷺ أَنْ يُبْطِلَ دَمَهُ ، فَوَدَاهُ بِمِائَةٍ مِنْ إِبِلِ الصَّدَقَةِ
