Musannaf Ibn Abi Shaybah 27819
Imam Zuhri states that the Holy Prophet (peace and blessings of Allah be upon him) decided in cases of Qisas (retribution) that the oath will be binding upon the claimant.
امام زہری فرماتے ہیں کہ نبی کریم (صلی اللہ علیہ وآلہ وسلم) نے قسامت میں یوں فیصلہ فرمایا کہ قسم مدعی علیہم پر لازم ہوگی۔
Imam Zuhri farmate hain keh Nabi Kareem (Sallallahu Alaihi Wasallam) ne qisamat mein yun faisla farmaya keh qasam muddai alaihim par lazim hogi.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا شَبَابَةُ بْنُ سَوَّارٍ ، عَنِ ابْنِ أَبِي ذِئْبٍ ، عَنِ الزُّهْرِيِّ : « أَنَّ النَّبِيَّ ﷺ قَضَى فِي الْقَسَامَةِ أَنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِمْ »
