كِتَابُ الدِّيَاتِ
The accusation oath by those who did not witness the crime.
الْقَسَامَةُ مَنْ لَمْ يَرَهَا
Musannaf Ibn Abi Shaybah 27853
Yahya bin Abu Ishaq narrated that he heard Salim bin 'Abdullah saying: "When a group from Banu Layth was ready to take an oath of Qasamah the next day, the Prophet (ﷺ) said: 'O servants of Allah! The people will swear an oath on something they did not see, nor were they present, nor were they witnesses to it. And if I had the authority in this matter, I would certainly punish them.' Or he said: 'I would make an example of them with a severe punishment, or I would make them an example, and I would not accept their testimony.'"
حضرت یحییٰ بن ابو اسحاق فرماتے ہیں کہ میں نے حضرت سالم بن عبداللہ کو یوں فرماتے ہوئے سنا : جبکہ بنو لیث کی ایک قوم اس بات کے لیے تیار ہوگئی تیہ کہ وہ اگلے دن قسامۃ کے معاملہ میں قسم اٹھائے گی اس پر آپ نے فرمایا : اے اللہ کے بندو ! قوم کے لوگ قسم اٹھائیں گے ایسی بات پر جو انھوں نے نہیں دیکھی اور نہ وہ موجود تھے اور نہ وہ اس پر گواہ تھے۔ اور اگر مجھے اس معاملہ میں اختیار ہوتا تو میں ان کو ضرور سزا دیتا یا یوں فرمایا : کہ میں ان کو عبرتناک سزا دیتا یا میں ان کو قابل عبرت بنا دیتا اور میں ان کی گواہی قبول نہ کرتا۔
Hazrat Yahya bin Abu Ishaq farmate hain keh maine Hazrat Salim bin Abdullah ko yun farmate huye suna: Jabkeh Banu Lais ki aik qaum is baat ke liye taiyar hogayi thi keh woh agle din qisamat ke mamle mein qasam uthayegi is par aap ne farmaya: Aye Allah ke bando! Qaum ke log qasam uthayenge aisi baat par jo unhon ne nahi dekhi aur na woh mojood thay aur na woh is par gawah thay. Aur agar mujhe is mamle mein ikhtiyar hota to main un ko zaroor saza deta ya yun farmaya: Keh main un ko ibratnak saza deta ya main un ko qabil e ibrat banata aur main un ki gawahi qubool na karta.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا ابْنُ عُلَيَّةَ ، عَنْ يَحْيَى بْنِ أَبِي إِسْحَاقَ ، قَالَ : سَمِعْتُ سَالِمَ بْنَ عَبْدِ اللَّهِ ، يَقُولُ : " وَقَدْ تَيَسَّرَ قَوْمٌ مِنْ بَنِي لَيْثٍ لِيَحْلِفُوا الْغَدَ فِي الْقَسَامَةِ ، فَقَالَ : « يَا لَعِبَادَ اللَّهِ لَقَوْمٌ يَحْلِفُونَ عَلَى مَا لَمْ يَرَوْهُ وَلَمْ يَحْضُرُوهُ وَلَمْ يَشْهَدُوهُ ، وَلَوْ كَانَ لِي أَوْ إِلَيَّ مِنَ الْأَمْرِ شَيْءٌ لَعَاقَبْتُهُمْ أَوْ لَنَكَلْتُهُمْ أَوْ لَجَعَلْتُهُمْ نَكَالًا وَمَا قَبِلْتُ لَهُمْ شَهَادَةً »
