Musannaf Ibn Abi Shaybah 27976
It is narrated from Hazrat Saeed and Hazrat Haram that a camel belonging to Hazrat Bara bin Aqeeb entered the garden of some people and destroyed their garden. In this regard, the Messenger of Allah (peace and blessings of Allah be upon him) decided: It is necessary for the owner to protect his property during the day, and the owner of the cattle will be responsible if his cattle cause any damage at night.
حضرت سعید اور حضرت حرام سے مروی ہے کہ حضرت براء بن عازب کی ایک اونٹنی کسی قوم کے باغ میں داخل ہوگئی اور ان کے باغ کو تباہ و برباد کردیا۔ اس بارے میں رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے یوں فیصلہ فرمایا : مالک پر اپنے مال کی دن میں حفاظت کرنا ضروری ہے اور مویشیوں والے پر ضمان ہوگا جب اس کے مویشی رات میں کوئی نقصان پہنچائیں۔
Hazrat Saeed aur Hazrat Haram se marvi hai keh Hazrat Bara bin Aazib ki aik oonthni kisi qaum ke bagh mein dakhil hogayi aur un ke bagh ko tabaah o barbad kardiya Iss baare mein Rasul Allah (Sallallahu Alaihi Wasallam) ne yun faisla farmaya Maalik par apne maal ki din mein hifazat karna zaroori hai aur maweshio wale par zaman hoga jab uske mawashi raat mein koi nuqsaan pohanchaien
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا ابْنُ عُيَيْنَةَ ، عَنِ الزُّهْرِيِّ ، عَنْ سَعِيدٍ ، وَحَرَامِ بْنِ سَعْدٍ : أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ قَوْمٍ ، فَأَفْسَدَتْ عَلَيْهِمْ فَقَضَى رَسُولُ اللَّهِ ﷺ أَنَّ حِفْظَ الْأَمْوَالِ عَلَى أَهْلِهَا بِالنَّهَارِ ، وَأَنَّ عَلَى أَهْلِ الْمَاشِيَةِ مَا أَصَابَتِ الْمَاشِيَةُ بِاللَّيْلِ "
