كِتَابُ الْحُدُودِ
Regarding a man who marries a woman, and she gives birth before he consummates the marriage.
فِي رَجُلٍ تَزَوَّجَ امْرَأَةً، فَجَاءَتْ بِوَلَدٍ قَبْلَ دُخُولِهِ بِهَا

Hazrat Mughira narrates that it was narrated to Hazrat Hammad regarding a man who is absent from his wife and has not consummated the marriage with her, then the woman became pregnant or gave birth to a child. You said: If his absence occurred in a distant land, then the woman's statement will not be accepted, and the punishment of adultery will be established upon her. And if he disappeared from a nearby area, then it will be assumed that he used to visit her secretly, so the woman's statement regarding the child will be considered true that it belongs to her husband.
حضرت مغیرہ فرماتے ہیں کہ حضرت حماد سے اس آدمی کے بارے میں مروی ہے جو اپنی بولی سے غائب ہوگیا ہو اور اس نے اس سے دخول بھی نہ کیا ہو پس وہ عورت حاملہ ہوگئی یا بچہ لے آئی۔ آپ نے فرمایا : اگر اس کا غائب ہونا کسی دور کے علاقہ میں ہوا ہو تو اس عورت کی تصدیق نہیں کی جائے گی اور اس پر حد قائم کردی جائے گی اور اگر وہ کسی قریب کے علاقہ ہی میں غائب ہوا ہو تو یوں سمجھا جائے گا کہ وہ اس کے پاس پوشیدگی میں آتا تھا تو بچہ کی عورت کی حق میں تصدیق کی جائے گی کہ وہ اسی شوہر سے ہے۔
Hazrat Mughirah farmate hain keh Hazrat Hammad se iss aadmi ke bare mein marvi hai jo apni biwi se ghaib ho gaya ho aur uss ne uss se dukhool bhi na kiya ho pas woh aurat hamila hogayi ya bachcha le aai Aap ne farmaya Agar uss ka ghaib hona kisi door ke ilaqe mein hua ho to uss aurat ki tasdeeq nahi ki jayegi aur uss par had qaim kardi jayegi aur agar woh kisi qareeb ke ilaqe hi mein ghaib hua ho to yun samjha jayega keh woh uss ke paas poshidaagi mein aata tha to bachcha ki aurat ki haq mein tasdeeq ki jayegi keh woh usi shohar se hai
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا جَرِيرٌ ، عَنْ مُغِيرَةَ ، عَنْ حَمَّادٍ فِي الرَّجُلِ يَغِيبُ عَنِ امْرَأَتِهِ وَلَمْ يَدْخُلْ بِهَا ، فَتَجِيءُ بِحَمْلٍ أَوْ بِوَلَدٍ ، قَالَ : « إِنْ كَانَتْ غَيْبَتُهُ بِأَرْضٍ بَعِيدَةٍ لَمْ تُصَدَّقْ وَيُقَامُ عَلَيْهَا الْحَدُّ ، وَإِنْ كَانَ فِي أَرْضٍ قَرِيبَةٍ يَرَوْنَ أَنَّهُ يَأْتِيهَا سِرًّا صُدِّقَتْ بِالْوَلَدِ أَنَّهُ مِنْ زَوْجِهَا »
