Regarding a drunk person who kills.

Musannaf Ibn Abi Shaybah 29091
Hazrat Kalib said that I came to Hazrat Umar during the Hajj season, so I called out to him from behind the tent, Beware! I am the inhabitant of such and such tribe of Jurmi, and indeed our nephew is imprisoned by the people of such and such tribe and we have presented before them the decision of the Messenger of Allah (peace and blessings of Allah be upon him) but they refused to accept it. Kalib said: Hazrat Umar lifted one side of the tent and then said: Do you recognize your companion? So Kalib said: Yes! There he is, then Umar said: You both go to him until the decision of the Messenger of Allah (peace and blessings of Allah be upon him) is enforced for you. Kalib said: We were saying that the decision was of four camels.
حضرت کلیب فرماتے ہیں کہ میں حج کے زمانے میں حضرت عمر کے پاس آیا، پس میں نے خیمہ کے پیچھے سے انھیں آواز دی، خبردار ! میں فلاں بن فلاں قبیلہ جرمی کا باشندہ ہوں، اور بیشک ہمارا بھانجھا فلاں قبیلے والوں کی قید میں ہے اور ہم نے ان کے سامنے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کا فیصلہ پیش کیا ہے پس انھوں نے اس کو ماننے سے انکار کردیا ہے ؟ کلیب کہتے ہیں : حضرت عمر نے خیمہ کی ایک جانب کو اٹھایا پھر فرمانے لگے : تو اپنے ساتھی کو پہچانتا ہے ؟ تو کلیب نے کہا : جی ہاں ! وہ سامنے ہے، پھر عمر نے فرمایا : تم دونوں اس کے پاس جاؤ یہاں تک کہ تیرے لیے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کا فیصلہ نافذ کردیا جائے گا کلیب کہتے ہیں : ہم کہہ رہے تھے کہ فیصلہ چار اونٹوں کا تھا۔
Hazrat Kulaib farmate hain keh main Hajj ke zamane mein Hazrat Umar ke paas aaya, pas maine khaime ke peeche se unhen aawaz di, Khabar dar! Main falan bin falan qabeela Jurmi ka bashinda hun, aur beshak hamara bhanja falan qabeele walon ki qaid mein hai aur humne unke samne Rasul Allah (Sallallahu Alaihi Wasallam) ka faisla pesh kiya hai pas unhon ne usko manne se inkar kar diya hai? Kulaib kehte hain: Hazrat Umar ne khaime ki ek janib ko uthaya phir farmane lage: To apne saathi ko pehchanta hai? To Kulaib ne kaha: Ji haan! Woh samne hai, phir Umar ne farmaya: Tum donon uske paas jao yahan tak ke tere liye Rasul Allah (Sallallahu Alaihi Wasallam) ka faisla nafiz kar diya jayega Kulaib kehte hain: Hum keh rahe the keh faisla chaar unton ka tha.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا ابْنُ إِدْرِيسَ ، عَنْ عَاصِمِ بْنِ كُلَيْبٍ ، عَنْ أَبِيهِ ، قَالَ : أَتَيْتُ عُمَرَ ﵁ وَهُوَ بِالْمَوْسِمِ مِنْ وَرَاءِ الْفُسْطَاطِ : أَلَا إِنِّي فُلَانُ بْنُ فُلَانٍ الْجَرْمِيُّ ، وَإِنَّ ابْنَ أُخْتٍ لَنَا عَانَ فِي بَنِي فُلَانٍ ، وَقَدْ عَرَضْنَا عَلَيْهِ قَضِيَّةَ رَسُولِ اللَّهِ ﷺ ، قَالَ : « وَكُنَّا نَتَحَدَّثُ أَنَّ الْقَضِيَّةَ كَانَتْ أَرْبَعًا مِنَ الْإِبِلِ »
