كِتَابُ الْفَرَائِضِ
Regarding the son of the one who was cursed if his mother dies, who inherits from him and who is his male heir
فِي ابْنِ الْمُلَاعَنَةِ إِذَا مَاتَتْ أُمُّهُ، مَنْ يَرِثُهُ وَمَنْ عَصَبَتُهُ

Shabi narrated to me that Shuaibi asked me about the opinion regarding the son of the woman who sought refuge from Abraham bin Yazid. I replied that he should be affiliated with his mother. Abraham said that he should be affiliated with his father. We went to Abdullah bin Harmuz, and he wrote a letter on our behalf to Madinah to those who had witnessed the incident. The reply to his letter stated that the Messenger of Allah (peace and blessings of Allah be upon him) had affiliated him with his mother.
شیبانی فرماتے ہیں کہ مجھ سے شعبی نے پوچھا کہ ابراہیم بن یزید کی لعان کرنے والی عورت کے بیٹے کے بارے میں کیا رائے ہے ؟ میں نے عرض کیا کہ اس کو اس کی ماں کے ساتھ ملایا جائے گا، اور ابراہیم نے فرمایا کہ اس کو اس کے باپ کے ساتھ ملایا جائے گا، پس ہم حضرت عبداللہ بن ہرمز کے پاس آئے تو انھوں نے ہماری خاطر مدینہ کی طرف ان لوگوں کو خط لکھا جن کے ساتھ یہ واقعہ پیش آیا تھا، چنانچہ ان کے خط کا جواب آیا کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے اس کو اس کی ماں کے ساتھ ملایا تھا۔
Shaibani farmate hain keh mujh se Shabi ne pucha keh Ibrahim bin Yazid ki laen karne wali aurat ke bete ke bare mein kya rai hai? Maine arz kiya keh usko uski maan ke sath milaya jayega, aur Ibrahim ne farmaya keh usko uske baap ke sath milaya jayega, pas hum Hazrat Abdullah bin Hurmuz ke paas aaye to unhon ne hamari khatir Madina ki taraf un logon ko khat likha jin ke sath yeh waqea pesh aaya tha, chunanche unke khat ka jawab aaya keh Rasul Allah (Sallallahu Alaihi Wasallam) ne usko uski maan ke sath milaya tha.
حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ ، عَنِ الشَّيْبَانِيِّ ، " عَنِ الشَّعْبِيِّ ، قَالَ : مَا رَأْيُ إِبْرَاهِيمَ بْنِ يَزِيدَ فِي ابْنِ الْمُلَاعَنَةِ فَقُلْتُ : يَلْحَقُ بِأُمِّهِ ، وَقَالَ إِبْرَاهِيمُ : يَلْحَقُ بِأَبِيهِ ، فَأَتَيْنَا عَبْدَ اللَّهِ بْنَ هُرْمُزَ ، فَكَتَبَ لَنَا إِلَى أَهْلِ الْمَدِينَةِ إِلَى أَهْلِ الْبَيْتِ الَّذِي كَانَ ذَلِكَ فِيهِمْ ، فَجَاءَ جَوَابُ كِتَابِهِمْ أَنَّ رَسُولَ اللَّهِ ﷺ أَلْحَقَهُ بِأُمِّهِ "
