Musannaf Ibn Abi Shaybah 31451
Abdullah ibn Ma'qal (may Allah be pleased with him) narrates: I have not seen any decision better than the decision of Muawiyah (may Allah be pleased with him) after the decision of the Companions of the Messenger of Allah (peace and blessings of Allah be upon him), which he made regarding the People of the Book, that we will be their heirs and they will not be our heirs, just as it is permissible for us to marry their women, but it is not permissible for them to marry our women.
عبداللہ بن معقل (رض) فرماتے ہیں کہ میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے صحابہ کے فیصلے کے بعد کوئی فیصلہ حضرت معاویہ (رض) کے فیصلے سے زیادہ بہتر نہیں دیکھا جو انھوں نے اہل کتاب کے بارے میں فرمایا تھا کہ ہم ان کے وارث ہوں گے اور وہ ہمارے وارث نہ ہوں گے، جیسا کہ ہمارے لیے ان کی عورتوں سے نکاح حلال ہے اور ان کے لیے ہماری عورتوں سے نکاح حلال نہیں۔
Abdullah bin Maqal (RA) farmate hain keh maine Rasool Allah (Sallallahu Alaihi Wasallam) ke Sahaba ke faisle ke baad koi faisla Hazrat Muawiya (RA) ke faisle se zyada behtar nahi dekha jo unhon ne Ahle Kitab ke bare mein farmaya tha keh hum unke waris honge aur woh humare waris na honge, jaisa keh humare liye unki auraton se nikah halal hai aur unke liye humari auraton se nikah halal nahi.
حَدَّثَنَا وَكِيعٌ ، قَالَ : حَدَّثَنَا إِسْمَاعِيلُ ، عَنِ الشَّعْبِيِّ ، عَنْ عَبْدِ اللَّهِ بْنِ مَعْقِلٍ ، قَالَ : مَا رَأَيْتُ قَضَاءً بَعْدَ قَضَاءِ أَصْحَابِ رَسُولِ اللَّهِ ﷺ ، أَحْسَنَ مِنْ قَضَاءٍ قَضَى بِهِ مُعَاوِيَةُ فِي أَهْلِ الْكِتَابِ قَالَ : « نَرِثُهُمْ ، وَلَا يَرِثُونَنَا كَمَا يَحِلُّ لَنَا النِّكَاحُ فِيهِمْ ، وَلَا يَحِلُّ لَهُمُ النِّكَاحُ فِينَا »
