كِتَابُ الْفَرَائِضِ
A slave married a free woman, and then he was freed after having children with her, to whom does the loyalty of his children go
مَمْلُوكٌ تَزَوَّجَ حُرَّةً، ثُمَّ إِنَّهُ أُعْتِقَ بَعْدَمَا وَلَدَتْ لَهُ أَوْلَادًا، لِمَنْ يَكُونُ وَلَاءُ وَلَدِهِ

Musannaf Ibn Abi Shaybah 31537
It is narrated on the authority of ash-Sha'bi, from 'Umar, 'Ali, 'Abdullah and Zayd (may peace be upon them) that they used to say: When a person is emancipated and he begets children from a free woman, he ('the emancipator) will inherit them. The narrator said that I said to ash-Sha'bi: What is the ruling about the grandfather? He said: The grandfather will inherit them just as the father inherits.
شعبی حضرت عمر، علی ، عبداللہ اور زید (رض) سے روایت کرتے ہیں کہ وہ فرماتے تھے کہ جب آدمی کو آزادی مل جائے اور اس کی آزاد عورت سے اولاد ہو تو وہ ان کی ولاء کو کھینچ لے گا، راوی کہتے ہیں کہ میں نے شعبی سے کہا کہ دادا کا کیا حکم ہے ؟ فرمایا کہ دادا بھی اسی طرح ولاء کھینچ لیتا ہے جس طرح باپ کھینچ لیتا ہے۔
Shuaibi Hazrat Umar, Ali, Abdullah aur Zaid (RA) se riwayat karte hain ki woh farmate the ki jab aadmi ko aazadi mil jaye aur uski aazaad aurat se aulad ho to woh unki wilayat ko khench lega, ravi kehte hain ki maine Shuaibi se kaha ki dada ka kya hukum hai? Farmaya ki dada bhi isi tarah wilayat khench leta hai jis tarah baap khench leta hai.
حَدَّثَنَا حَفْصٌ ، عَنْ أَشْعَثَ ، عَنِ الشَّعْبِيِّ ، عَنْ عُمَرَ ، وَعَلِيٍّ ، وَعَبْدِ اللَّهِ ، وزَيْدٍ ، كَانُوا يَقُولُونَ : « إِذَا لَحِقَتْهُ الْعَتَاقَةُ وَلَهُ أَوْلَادٌ مِنْ حُرَّةٍ جَرَّ وَلَاءَهُمْ » فَقُلْتُ لِلشَّعْبِيِّ : فَالْجَدُّ ؟ قَالَ : « الْجَدُّ يَجُرُّ كَمَا يَجُرُّ الْأَبُ »
