كِتَابُ الْفَرَائِضِ
A slave married a free woman, and then he was freed after having children with her, to whom does the loyalty of his children go
مَمْلُوكٌ تَزَوَّجَ حُرَّةً، ثُمَّ إِنَّهُ أُعْتِقَ بَعْدَمَا وَلَدَتْ لَهُ أَوْلَادًا، لِمَنْ يَكُونُ وَلَاءُ وَلَدِهِ

Musannaf Ibn Abi Shaybah 31536
Ikrimah reported on the authority of Ibrahim, saying: I think he narrated it from Aswad that Umar said: When a free woman comes under the authority of a slave and gives birth to a child, then the wala' of her child will be for the master of the mother. When the father becomes free, he will take over the wala'.
اعمش ابراہیم سے روایت کرتے ہیں اور فرماتے ہیں کہ میرا خیال ہے کہ انھوں نے اسود سے یہ روایت کی ہے کہ حضرت عمر نے فرمایا کہ جب آزاد عورت غلام کے ماتحت ہو اور اولاد جنے تو اس کی اولاد کی ولاء ماں کے موالی کے لیے ہے، جب باپ آزاد ہوگا تو ولاء کو کھینچ لے گا۔
Aamesh Ibrahim se riwayat karte hain aur farmate hain ke mera khayal hai ke unhon ne Aswad se yeh riwayat ki hai ke Hazrat Umar ne farmaya ke jab azad aurat ghulam ke matahat ho aur aulad janye to uski aulad ki wilayat maan ke mawali ke liye hai, jab baap azad hoga to wilayat ko khench lega.
حَدَّثَنَا وَكِيعٌ ، قَالَ : ثنا الْأَعْمَشُ ، عَنْ إِبْرَاهِيمَ ، قَالَ الْأَعْمَشُ : أَرَاهُ عَنِ الْأَسْوَدِ ، قَالَ عُمَرُ : « إِذَا كَانَتِ الْحُرَّةُ تَحْتَ الْمَمْلُوكِ فَوَلَدَتْ فَوَلَاءُ وَلَدِهَا لِمَوَالِي الْأُمِّ ، فَإِذَا أُعْتِقَ الْأَبُ جَرَّ الْوَلَاءَ »
