كِتَابُ الْفَرَائِضِ
Regarding a man who dies and no heir is known for him.
فِي الرَّجُلِ يَمُوتُ، وَلَا يُعْرَفُ لَهُ وَارِثٌ

People say that a question was asked about a man who stole and died, and he left no "Maula Ataqah" or any heir, you said that his wealth will be spent where he spent it, if he did not make any will, then his wealth will go to Baitulmal.
شعبی فرماتے ہیں کہ مسروق سے ایک آدمی کے بارے میں پوچھا گیا جو مرگیا تھا اور مرتے وقت اس نے ” مولیٰ عتاقہ “ یا کوئی وارث نہیں چھوڑا ، آپ نے فرمایا کہ اس کا مال وہیں لگے گا جہاں اس نے لگایا، اگر اس نے کوئی وصیت نہیں کی تھی تو اس کا مال بیت المال میں جائے گا۔
Shobai farmaty hain k masrooq se aik aadmi k bary mein poocha gaya jo margaya tha aur marty waqt us ne "Mola Ataka" ya koi waris nahi chora, aap ne farmaya k us ka maal wahin lagy ga jahan us ne lagaya, agar us ne koi wasiyat nahi ki thi to us ka maal baitul maal mein jaye ga.
حَدَّثَنَا وَكِيعٌ ، عَنْ إِسْمَاعِيلَ ، عَنِ الشَّعْبِيِّ ، عَنْ مَسْرُوقٍ ، سُئِلَ عَنْ رَجُلٍ مَاتَ وَلَمْ يَتْرُكْ مَوْلًى عَتَاقَةً ، وَلَا وَارِثًا ، قَالَ : « مَالُهُ حَيْثُ وَضَعَهُ ، فَإِنْ لَمْ يَكُنْ أَوْصَى بِشَيْءٍ ، فَمَالُهُ فِي بَيْتِ الْمَالِ »
