Who receives from the fifth of the spoils and how it is distributed
مَنْ يُعْطَى مِنَ الْخُمُسِ وَفِيمَنْ يُوضَعُ

Hazrat Mak'hul (may Allah be pleased with him) said that Khums is like Fay'. The Imam will give it to both the rich and the poor. Hazrat Umar bin Abdul Aziz wrote: The way of general Fay' is also the way of Khums.
حضرت مکحول (رض) فرماتے ہیں کہ خمس بھی فئی کی طرح ہے، اس میں سے امام مالدار اور فقیر دونوں کو دے گا۔ حضرت عمر بن عبدالعزیز نے تحریر فرمایا : جو عام فئی کا راستہ ہے وہ خمس کا بھی راستہ ہے۔
Hazrat Makhool (RA) farmate hain keh khums bhi fay ki tarah hai, is mein se Imam maldar aur faqir dono ko de ga. Hazrat Umar bin Abdul Aziz ne tahreer farmaya: Jo aam fay ka rasta hai wo khums ka bhi rasta hai.
حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ ، عَنْ مُحَمَّدِ بْنِ رَاشِدٍ ، عَنْ مَكْحُولٍ قَالَ : الْخُمُسُ بِمَنْزِلَةِ الْفَيْءِ ، يُعْطِي مِنْهُ الْإِمَامُ الْغَنِيَّ وَالْفَقِيرَ ". قَالَ : وَأَخْبَرَنِي لَيْثُ بْنُ أَبِي رُقَيَّةَ ، أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ كَتَبَ : أَنَّ سَبِيلَ الْخُمُسِ سَبِيلُ عَامَّةِ الْفَيْءِ "
