كِتَابُ الْسير
People of the covenant (non-Muslims) being captured and then retaken by Muslims
أَهْلُ الذِّمَّةِ يُسْبَوْنَ ثُمَّ يَظْهَرُ عَلَيْهِمِ الْمُسْلِمُونَ

Hadrat Masawir al-Warraq (may Allah be pleased with him) narrates: I asked Hadrat Sha'bi (may Allah be pleased with him): "A woman from among the Dhimmis was taken captive by the enemy. Then the Muslims overpowered them, and one such woman came into the possession of a Muslim. What is the ruling about her?" Hadrat Sha'bi replied, "She will be returned to those with whom there is a treaty."
حضرت مساور الوراق (رض) فرماتے ہیں کہ میں نے حضرت شعبی (رض) سے دریافت کیا کہ ذمیوں کی ایک خاتون کو دشمنوں نے قید کرلیا پھر ان پر مسلمان غالب آگئے اور وہ ایک خاتون مسلمان کے حصہ میں آئی تو اس کا کیا حکم ہے ؟ حضرت شعبی نے فرمایا : جن سے عہد ہے ان کو واپس کردی جائے گی۔
Hazrat Miswar Alwaraq farmate hain keh maine Hazrat Shaabi se daryaft kiya keh zimmiyon ki ek khatoon ko dushmanon ne qaid karliya phir un par musalman ghalib aagaye aur wo ek khatoon musalman ke hissa mein aai to uska kya hukum hai? Hazrat Shaabi ne farmaya: Jin se ahd hai un ko wapas kardi jayegi.
حَدَّثَنَا عِيسَى بْنُ يُونُسَ ، عَنْ مُسَاوِرٍ الْوَرَّاقِ قَالَ : " سَأَلْتُ الشَّعْبِيَّ عَنِ امْرَأَةٍ ، مِنْ أَهْلِ الذِّمَّةِ سَبَاهَا الْعَدُوُّ ، ثُمَّ ظَهَرَ عَلَيْهَا الْمُسْلِمُونَ فَوَقَعَتْ فِي سَهْمِ رَجُلٍ مِنْهُمْ قَالَ : تُرَدُّ إِلَى أَهْلِهَا "
