The Musnad of Abdullah ibn al-Abbas ibn Abd al-Muttalib (may Allah be pleased with them both)

Musnad Ahmad ibn Hanbal 1984
It is narrated on the authority of Sayyiduna Ibn 'Abbas (may Allah be pleased with them both) that regarding a scribe who has been partially freed (and someone kills him), the Prophet (peace and blessings of Allah be upon him) gave the verdict: "He will be compensated as a free man for the portion of his Kitabat (contract of emancipation) that he has already paid, and for the portion that remains, he will be compensated as a slave."

سیدنا ابن عباس رضی اللہ عنہما سے مروی ہے کہ جس مکاتب کو آزاد کر دیا گیا ہو (اور کوئی شخص اسے قتل کر دے) تو نبی ﷺ نے اس کے متعلق یہ فیصلہ فرمایا ہے کہ ”جتنا بدل کتابت وہ ادا کر چکا ہے، اس کے مطابق اسے آزاد آدمی کی دیت دی جائے گی، اور جتنے حصے کی ادائیگی باقی ہونے کی وجہ سے وہ غلام ہے، اس میں غلام کی دیت دی جائے گی۔“
Sayyidna Ibn Abbas Radi Allaho Anhuma se marvi hai ki jis maktab ko azad kar diya gaya ho (aur koi shakhs usay qatal kar de) to Nabi Sallallaho Alaihi Wasallam ne uske mutalliq ye faisla farmaya hai ki "jitna badal kitaabat wo ada kar chuka hai uske mutabiq usay azad aadmi ki diyat di jayegi aur jitne hisse ki adayegi baqi hone ki waja se wo ghulam hai usme ghulam ki diyat di jayegi"
حَدَّثَنَا إِسْمَاعِيلُ ، حَدَّثَنَا هِشَامٌ الدَّسْتُوَائِيُّ ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" فِي الْمُكَاتَبِ يَعْتِقُ مِنْهُ بِقَدْرِ مَا أَدَّى دِيَةَ الْحُرِّ، وَبِقَدْرِ مَا رَقَّ مِنْهُ دِيَةَ الْعَبْدِ".
