Musnad Ahmad ibn Hanbal 4490
It is narrated on the authority of Sayyiduna Ibn Umar (may Allah be pleased with him) that the Holy Prophet (peace and blessings of Allah be upon him) forbade the sale of Muzabanah. Muzabanah refers to selling dates while they are still on the trees based on an estimate, saying that if the yield is more, it belongs to the seller, and if it's less, it still belongs to the seller. Sayyiduna Ibn Umar (may Allah be pleased with him) states that Sayyiduna Zayd bin Thabit (may Allah be pleased with him) narrated this hadith to me, adding that the Holy Prophet (peace and blessings of Allah be upon him) permitted the sale of Araya based on an estimate.

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ نبی کریم ﷺ نے بیع مزابنہ کی ممانعت فرمائی ہے، بیع مزابنہ کا مطلب یہ ہے کہ درختوں پر لگی ہوئی کھجور کو ایک معین اندازے سے بیچنا اور یہ کہنا کہ اگر اس سے زیادہ نکلیں تو میری اور اگر کم ہو گئیں تب بھی میری۔ سیدنا ابن عمر رضی اللہ عنہما فرماتے ہیں کہ سیدنا زیاد بن ثابت رضی اللہ عنہ نے مجھ سے یہ حدیث بیان کی ہے کہ نبی کریم ﷺ نے اندازے کے ساتھ بیع عرایا کی اجازت دی ہے۔
Sayyidna Ibn Umar RA se marvi hai keh Nabi Kareem SAW ne Bay Mazabanah ki mumanat farmai hai, Bay Mazabanah ka matlab yeh hai keh darakhton par lagi hui khajoor ko ek moayyan andazay se bechna aur yeh kehna keh agar is se zyada niklein to meri aur agar kam ho gayeen tab bhi meri. Sayyidna Ibn Umar RA farmate hain keh Sayyidna Zaid bin Sabit RA ne mujh se yeh hadees bayaan ki hai keh Nabi Kareem SAW ne andazay ke sath Bay Araya ki ijazat di hai.
حَدَّثَنَا إِسْمَاعِيلُ ، أَخْبَرَنَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ" نَهَى عَنِ الْمُزَابَنَةِ، وَالْمُزَابَنَةُ أَنْ يُبَاعَ مَا فِي رُؤُوسِ النَّخْلِ بِتَمْرٍ بِكَيْلٍ مُسَمًّى، إِنْ زَادَ فَلِي، وَإِنْ نَقَص فَعَلَيَّ". (حديث موقوف) قَالَ ابْنُ عُمَرَ: حَدَّثَنِي زَيْدُ بْنُ ثَابِتٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ" رَخَّصَ فِي بَيْعِ الْعَرَايَا بِخَرْصِهَا".
