Musnad Ahmad ibn Hanbal 5025
Yunus bin Jubair (may Allah have mercy on him) once asked Abdullah ibn Umar (may Allah be pleased with him) about a man who divorced his wife during her menstrual period. He (Ibn Umar) said, "Do you know Abdullah ibn Umar? He also divorced his wife during her menstrual period. Umar (may Allah be pleased with him) went to the Prophet (peace and blessings of Allah be upon him) and told him about it. The Prophet (peace and blessings of Allah be upon him) said: 'Tell him to take her back, then if he wants to divorce her, he should do so when she is pure (not menstruating).'" I (Yunus) asked Ibn Umar: "Will that (divorce) be counted?" He (Ibn Umar) said: "Tell me, do you want to prove him (the Prophet) foolish and stupid?"

یونس بن جبیر رحمتہ اللہ علیہ نے ایک مرتبہ سیدنا ابن عمر رضی اللہ عنہما سے اس شخص کے متعلق پوچھا: جو ایام کی حالت میں اپنی بیوی کو طلاق دے دے، تو انہوں نے فرمایا کہ کیا تم عبداللہ بن عمر رضی اللہ عنہما کو جانتے ہو، اس نے بھی اپنی بیوی کو ایام کی حالت میں طلاق دے دی تھی، سیدنا عمر رضی اللہ عنہ نے جا کر نبی ﷺ کو یہ بات بتائی، تو نبی ﷺ نے فرمایا: ”اسے کہو کہ وہ اس سے رجوع کر لے، پھر اگر وہ اسے طلاق دینا ہی چاہے تو طہر کے دوران دے،“ میں نے سیدنا ابن عمر رضی اللہ عنہما سے پوچھا کہ کیا اس کی وہ طلاق شمار کی جائے گی؟ فرمایا: یہ بتاؤ، کیا تم اسے بیوقوف اور احمق ثابت کرنا چاہتے ہو۔
Younas bin Jabir rehmatullah alaih ne ek martaba sayyiduna Ibn Umar razi Allah anhuma se is shakhs ke mutaliq poocha: jo ayaam ki halat mein apni biwi ko talaq de de, to unhon ne farmaya ke kya tum Abdullah bin Umar razi Allah anhuma ko jante ho, is ne bhi apni biwi ko ayaam ki halat mein talaq de di thi, sayyiduna Umar razi Allah anhu ne ja kar Nabi (صلى الله عليه وآله وسلم) ko yeh baat batai, to Nabi (صلى الله عليه وآله وسلم) ne farmaya: "ise kaho ke woh is se ruju kar le, phir agar woh ise talaq dena hi chahe to taher ke dauran de," mein ne sayyiduna Ibn Umar razi Allah anhuma se poocha ke kya is ki woh talaq shumar ki jaye gi? farmaya: yeh batao, kya tum ise bewakoof aur ahmaq sabit karna chahte ho.
حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، وَعَبْدُ اللَّهِ بْنُ بَكْرٍ ، قَالَا: حَدَّثَنَا سَعِيدٌ ، عَنْ قَتَادَةَ ، عَنْ يُونُسَ بْنِ جُبَيْرٍ ، أَنَّهُ سَأَلَ ابْنَ عُمَرَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ؟ فَقَالَ: أَتَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ؟ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ حَائِضًا، فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَخْبَرَهُ بِذَلِكَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" مُرْهُ فَلْيُرَاجِعْهَا، ثُمَّ إِنْ بَدَا لَهُ طَلَاقُهَا طَلَّقَهَا فِي قُبُلِ عِدَّتِهَا"، قَالَ ابْنُ بَكْرٍ:" أَوْ فِي قُبُلِ طُهْرِهَا"، فَقُلْتُ لِابْنِ عُمَرَ: أَيُحْسَبُ طَلَاقُهُ ذَلِكَ طَلَاقًا؟ قَالَ: نَعَمْ، أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ؟!.
