Musnad Ahmad ibn Hanbal 5270
It is narrated by Ibn Umar (may Allah be pleased with him) that he divorced his wife during her menstrual period and informed Umar (may Allah be pleased with him) about it. Umar (may Allah be pleased with him) went to the Prophet (peace and blessings of Allah be upon him) and informed him about it. The Prophet (peace and blessings of Allah be upon him) said: "He should keep her with him until she has another period after this one and becomes pure from it. Then, if he wishes to divorce her, he may divorce her according to the decree of Allah. And if he wishes to keep her, he may keep her."

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ انہوں نے اپنی بیوی کو اس کے ”ایام“کی حالت میں طلاق دے دی اور سیدنا عمر رضی اللہ عنہ کو بھی یہ بات بتا دی، سیدنا عمر رضی اللہ عنہ نے بارگاہ رسالت میں حاضر ہو کر نبی ﷺ کو اس سے مطلع کیا، نبی ﷺ نے فرمایا: ”اسے چاہیے کہ اسے اپنے پاس ہی رکھے، یہاں تک کہ ان ایام کے علاوہ اسے ایام کا دوسرا دور آ جائے اور وہ اس سے بھی پاک ہو جائے، پھر اگر اسے طلاق دینے کی رائے ہو تو حکم الہٰی کے مطابق اسے طلاق دے دے اور اگر اپنے پاس رکھنے کی رائے ہو تو اپنے پاس رہنے دے۔“
Saina Ibn Umar razi Allah anhuma se marvi hai keh unhon ne apni biwi ko uss ke "Ayaam" ki halat mein talaq de di aur Saina Umar razi Allah anhu ko bhi yeh baat bata di, Saina Umar razi Allah anhu ne bargah risalat mein hazir ho kar Nabi (صلى الله عليه وآله وسلم) ko iss se muttala kia, Nabi (صلى الله عليه وآله وسلم) ne farmaya: "Issey chahiye keh issey apne pass hi rakhey, yahan tak keh in ayaam ke alawa issey ayaam ka doosra daur aa jaye aur woh iss se bhi pak ho jaye, phir agar issey talaq dene ki rai ho to hukm elai ke mutabiq issey talaq de de aur agar apne pass rakhne ki rai ho to apne pass rehne de."
حَدَّثَنَا رَوْحٌ ، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ ، حَدَّثَنَا ابْنُ شِهَابٍ ، عَنْ سَالِمٍ ، عَنْ أَبِيهِ ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، فَذَكَرَ ذَلِكَ إِلَى عُمَرَ، فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" لِيُمْسِكْهَا حَتَّى تَحِيضَ غَيْرَ هَذِهِ الْحَيْضَةِ، ثُمَّ تَطْهُرَ، فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا، فَلْيُطَلِّقْهَا كَمَا أَمَرَهُ اللَّهُ عَزَّ وَجَلَّ، وَإِنْ بَدَا لَهُ أَنْ يُمْسِكَهَا، فَلْيُمْسِكْهَا".
