Musnad Ahmad ibn Hanbal 5306
It was narrated from Ibn 'Umar that the Messenger of Allah (ﷺ) said: "Whoever sells a tree in which date palms have been grafted, its fruits belong to the seller, unless the purchaser stipulates otherwise at the time of purchase (that he is buying the tree along with its fruits).

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ رسول اللہ ﷺ نے فرمایا: ”جو شخص کسی ایسے درخت کو فروخت کرے جس میں کھجوروں کی پیوندکاری کی گئی ہو تو اس کا پھل بائع کی ملکیت میں ہو گا، الاّ یہ کہ مشتری خریدتے وقت اس کی بھی شرط لگا دے (کہ میں یہ درخت پھل سمیت خرید رہا ہوں)۔
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki Rasul Allah (صلى الله عليه وآله وسلم) ne farmaya: "Jo shakhs kisi aise darakht ko farokht kare jismein khajuron ki paiwandkari ki gai ho to uska phal ba'i ki milkiyat mein hoga, illa yeh ki mushteri kharidte waqt uski bhi shart laga de (keh mein yeh darakht phal samet kharid raha hun)."
حَدَّثَنَا عَبْدُ الرَّحْمَنِ ، عَنْ مَالِكٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:" مَنْ بَاعَ نَخْلًا قَدْ أُبِرَتْ، فَثَمَرَتُهَا لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ".
