Musnad Ahmad ibn Hanbal 6136
It is narrated on the authority of Sayyiduna Ibn Umar (may Allah be pleased with them both) that when Sayyiduna Uthman bin Maz'un (may Allah be pleased with him) passed away, he left behind a daughter from his marriage to Khawla bint Hakim bin Umayya bin Haritha bin Aloqss. Before his death, he had appointed his brother, Sayyiduna Qudama bin Maz'un (may Allah be pleased with him), as his successor. Both of them were my uncles. I sent a marriage proposal for the daughter of Sayyiduna Uthman (may Allah be pleased with him) through Sayyiduna Qudama (may Allah be pleased with him), and he accepted the proposal and married her to me. Meanwhile, Sayyiduna Mughirah bin Shu'ba (may Allah be pleased with him) approached her mother and enticed her with wealth and riches. She, in turn, was swayed, and seeing her mother's inclination, the girl also became inclined and both of them refused the initial proposal. Finally, the matter was presented before the Prophet (peace and blessings of Allah be upon him). Sayyiduna Qudama (may Allah be pleased with him) said, "O Messenger of Allah! This is the daughter of my brother, and he himself had entrusted me with her. I found no fault in seeking a suitable match for her and ensuring her well-being, but she, being a woman, is now inclined towards another proposal due to her mother's influence." The Prophet (peace and blessings of Allah be upon him) said, "She is an orphan, and her marriage cannot be conducted without her consent." Sayyiduna Ibn Umar (may Allah be pleased with them both) said, "By Allah, after she came under my guardianship, she was taken away from me and married to Sayyiduna Mughirah bin Shu'ba (may Allah be pleased with him)."

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ جب سیدنا عثمان بن مظعون رضی اللہ عنہ کا انتقال ہوا تو ان کے ورثاء میں ایک بیٹی تھی جو خویلہ بنت حکیم بن امیہ بن حارثہ بن الاوقص سے پیدا ہوئی تھی، انہوں نے اپنے بھائی سیدنا قدامہ بن مظعون رضی اللہ عنہ کو اپنا وصی مقرر کیا تھا یہ دونوں میرے ماموں تھے میں نے سیدنا قدامہ رضی اللہ عنہ کے پاس سیدنا عثمان رضی اللہ عنہ کی بیٹی سے اپنے لئے پیغام نکاح بھیجاجو انہوں نے قبول کر لیا اور میرے ساتھ اس کی شادی کر دی اسی دوران سیدنا مغیرہ بن شعبہ رضی اللہ عنہ اس کی ماں کے پاس آئے اور اسے مال و دولت کا لالچ دیا اور پھسل گئی اور لڑکی بھی اپنی ماں کی رغبت کو دیکھتے ہوئے پھسل گئی اور دونوں نے اس رشتے سے انکار کر دیا۔ بالآخریہ معاملہ نبی ﷺ کی خدمت میں پیش کیا گیا سیدنا قدامہ رضی اللہ عنہ کہنے لگے یا رسول اللہ! یہ میرے بھائی کی بیٹی ہے اس نے مجھے خود اس کے متعلق وصیت کی تھی میں نے اس کا نکاح اس کے پھوپھی زادبھائی عبداللہ بن عمر سے کر دیا میں نے جوڑ تلاش کرنے میں اور بہتری و صلاح کو جانچنے میں کسی قسم کی کوتاہی نہیں کی لیکن یہ بھی ایک عورت ہے اور اپنی ماں کی رغبت دوسری طرف دیکھتے ہوئے پھسل رہی ہے؟ نبی ﷺ نے ارشاد فرمایا: یہ یتیم بچی ہے، اس کا نکاح اس کی اجازت کے بغیر نہ کیا جائے سیدنا ابن عمر رضی اللہ عنہما فرماتے ہیں کہ واللہ اسے میری ملکیت میں آنے کے بعد مجھ سے چھین لیا گیا اور سیدنا مغیرہ بن شعبہ رضی اللہ عنہ سے اس کا نکاح کر دیا گیا۔
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki jab Sayyidna Usman bin Mazoon (رضي الله تعالى عنه) ka inteqal hua to un ke warisa mein ek beti thi jo Khuwayla bint Hakim bin Umayya bin Haritha bin Al-Aqsa se paida hui thi, unhon ne apne bhai Sayyidna Qudama bin Mazoon (رضي الله تعالى عنه) ko apna vasi muqarrar kiya tha yeh donon mere mamun the maine Sayyidna Qudama (رضي الله تعالى عنه) ke pass Sayyidna Usman (رضي الله تعالى عنه) ki beti se apne liye paigham nikah bheja jo unhon ne qubool kar liya aur mere sath uski shadi kar di isi dauran Sayyidna Mughira bin Shaaba (رضي الله تعالى عنه) uski maan ke pass aaye aur use maal o daulat ka lalach diya aur phisal gayi aur ladki bhi apni maan ki ragbat ko dekhte huye phisal gayi aur donon ne is rishte se inkar kar diya. Balakhir yeh mamla Nabi (صلى الله عليه وآله وسلم) ki khidmat mein pesh kiya gaya Sayyidna Qudama (رضي الله تعالى عنه) kahne lage ya Rasul Allah! yeh mere bhai ki beti hai isne mujhe khud uske mutalliq vasiyat ki thi maine uska nikah uske phoopha zad bhai Abdullah bin Umar se kar diya maine jor talash karne mein aur behtari o salah ko janchne mein kisi qism ki kotahi nahi ki lekin yeh bhi ek aurat hai aur apni maan ki ragbat dusri taraf dekhte huye phisal rahi hai? Nabi (صلى الله عليه وآله وسلم) ne irshad farmaya: yeh yatim bachi hai, uska nikah uski ijazat ke baghair na kiya jaye Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a farmate hain ki Wallahi use meri milk mein aane ke baad mujh se chhin liya gaya aur Sayyidna Mughira bin Shaaba (رضي الله تعالى عنه) se uska nikah kar diya gaya.
حَدَّثَنَا يَعْقُوبُ ، حَدَّثَنَا أَبِي ، عَنِ ابْنِ إِسْحَاقَ ، حَدَّثَنِي عُمَرُ بْنُ حُسَيْنِ بْنِ عَبْدِ اللَّهِ مَوْلَى آلِ حَاطِبٍ، عَنْ نَافِعٍ مَوْلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، قَالَ: تُوُفِّيَ عُثْمَانُ بْنُ مَظْعُونٍ، وَتَرَكَ ابْنَةً لَهُ مِنْ خُوَيْلَةَ بِنْتِ حَكِيمِ بْنِ أُمَيَّةَ بْنِ حَارِثَةَ بْنِ الْأَوْقَصِ، قَالَ: وَأَوْصَى إِلَى أَخِيهِ قُدَامَةَ بْنِ مَظْعُونٍ، قَالَ عَبْدُ اللَّهِ : وَهُمَا خَالَايَ، قَالَ: فَخَطَبْتُ إِلَى قُدَامَةَ بْنِ مَظْعُونٍ , ابْنَةَ عُثْمَانَ بْنِ مَظْعُونٍ، فَزَوَّجَنِيهَا، وَدَخَلَ الْمُغِيرَةُ بْنُ شُعْبَةَ , يَعْنِي: إِلَى أُمِّهَا، فَأَرْغَبَهَا فِي الْمَالِ، فَحَطَّتْ إِلَيْهِ، وَحَطَّتْ الْجَارِيَةُ إِلَى هَوَى أُمِّهَا، فَأَبَيَا، حَتَّى ارْتَفَعَ أَمْرُهُمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ قُدَامَةُ بْنُ مَظْعُونٍ: يَا رَسُولَ اللَّهِ، ابْنَةُ أَخِي، أَوْصَى بِهَا إِلَيَّ، فَزَوَّجْتُهَا ابْنَ عَمَّتِهَا عَبْدَ اللَّهِ بْنَ عُمَرَ، فَلَمْ أُقَصِّرْ بِهَا فِي الصَّلَاحِ وَلَا فِي الْكَفَاءَةِ، وَلَكِنَّهَا امْرَأَةٌ، وَإِنَّمَا حَطَّتْ إِلَى هَوَى أُمِّهَا، قَالَ: فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" هِيَ يَتِيمَةٌ، وَلَا تُنْكَحُ إِلَّا بِإِذْنِهَا"، قَالَ: فَانْتُزِعَتْ وَاللَّهِ مِنِّي بَعْدَ أَنْ مَلَكْتُهَا، فَزَوَّجُوهَا الْمُغِيرَةَ بْنَ شُعْبَةَ.
