Musnad Ahmad ibn Hanbal 6742
Narrated by Sayyiduna Ibn 'Amr (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever raises a weapon against us or ambushes us on the way is not one of us. And whoever is killed in a way other than this, then it is called 'quasi-intentional killing' and its blood money will be severe, except that in this case the killer will not be killed, and he will be like the sanctity of the sacred month for inviolability and neighborhood."

سیدنا ابن عمرو رضی اللہ عنہ سے مروی ہے کہ رسول اللہ ﷺ نے ارشاد فرمایا: ”جو ہم پر اسلحہ اٹھاتا ہے یا راستہ میں گھات لگاتا ہے وہ ہم میں سے نہیں ہے اور جو شخص اس کے علاوہ صورت میں مارآ جائے تو اسے " شبہ عمد " کہا جاتا ہے اور اس کی دیت مغلظہ ہو گی، البتہ اس صورت میں قاتل کو قتل نہیں کیا جائے گا اور وہ حرمت اور پڑوس کے لئے حرمت والے مہینے کی طرح ہے۔
Syedna Ibn Amr RA se marvi hai ki Rasul Allah SAW ne irshad farmaya: "Jo hum par aslaha uthata hai ya rastay mein ghaat lagata hai wo hum mein se nahi hai aur jo shakhs iske ilawa soorat mein mara jaye to use "shabah amd" kaha jata hai aur iski deyat mughalza ho gi, albatta is soorat mein qatil ko qatl nahi kiya jaye ga aur wo hurmat aur padoos ke liye hurmat wale mahine ki tarah hai."
حَدَّثَنَا عَبْدُ الصَّمَدِ ، حَدَّثَنَا مُحَمَّدُ بْنُ رَاشِدٍ ، حَدَّثَنَا سُلَيْمَانُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ:" مَنْ حَمَلَ عَلَيْنَا السِّلَاحَ، فَلَيْسَ مِنَّا، وَلَا رَصَدَ بِطَرِيقٍ، وَمَنْ قُتِلَ عَلَى غَيْرِ ذَلِكَ، فَهُوَ شِبْهُ الْعَمْدِ، وَعَقْلُهُ مُغَلَّظٌ، وَلَا يُقْتَلُ صَاحِبُهُ، وَهُوَ كَالشَّهْرِ الْحَرَامِ، لِلْحُرْمَةِ وَالْجِوَارِ".
