Chapter that a Muslim cultivates land from the land of Kharaaj, and upon him is the tenth or half of the tenth in his cultivation.
باب المسلم يزرع أرضا من أرض الخراج فيكون عليه في زرعه العشر أو نصف العشر
Sunan al-Kubra Bayhaqi 7497
'Amr bin Maimun bin Mihran reported: I asked 'Umar bin 'Abdul-'Aziz about the zakat of a Muslim who possesses a taxable land and when the zakat is demanded from him, he says: I am also to pay its tax. Thereupon, he ('Umar bin 'Abdul-'Aziz) said: The tax is on land and the zakat on the produce. He (the narrator) said: I asked him again and he gave the same reply.

(٧٤٩٧) عمرو بن میمون بن مہران فرماتے ہیں : میں نے عمر بن عبد العزیز سے اس مسلمان کی زکوۃ کے بارے میں پوچھا جس کے پاس ٹیکس والی زمین ہو اور اس سے زکوۃ پوچھی جاتی تو وہ کہتا کہ میرے ذمے اس کا ٹیکس بھی ہے تو وہ کہتے کہ ٹیکس زمین پر ہے اور زکوۃ پیداوار پر ۔ وہ کہتے ہیں : میں نے ایک مرتبہ پھر پوچھا تو انھوں نے یہی جواب دیا۔
Amr bin Maimoon bin Mahran farmate hain : maine Umar bin Abd al-Aziz se is musalman ki zakat ke bare mein poocha jis ke paas tax wali zameen ho aur us se zakat poochi jati to woh kehta kah mere zimme is ka tax bhi hai to woh kehte kah tax zameen par hai aur zakat paidawar par . Woh kehte hain : maine ek martaba phir poocha to unhon ne yahi jawab diya.
Yunus said: I asked Zuhri about the zakat of the land which is given on lease. He said: Muslims always used to do so in the time of the Messenger of Allah (peace and blessings of Allah be upon him) and after him, and they used to rent it out but also used to pay its zakat. We consider this land to be the same.

(٧٤٩٨) یونس فرماتے ہیں کہ میں نے زہری سے اس زمین کی زکوۃ کے بارے میں جس پر ٹیکس ہی پوچھا تو انھوں نے فرمایا : مسلمان ہمیشہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے دور میں اور اس کے بعد بھی ایسا ہی کیا کرتے تھے اور کرائے پر لیا کرتے تھے مگر زکوۃ بھی ادا کیا کرتے تھے ہم اس زمین کو بھی ویسے ہی تصور کرتے ہیں۔
7498 Younus farmaty hain keh maine zahri se is zameen ki zakat ke bary mein jis par tax hi poocha to unhon ne farmaya: Musalman hamesha Rasool Allah ((صلى الله عليه وآله وسلم)) ke daur mein aur uske baad bhi aisa hi kya karte thy aur kiraye par liya karte thy magar zakat bhi ada kya karte thy hum is zameen ko bhi waisy hi tasawwur karte hain.
Alqama reported on the authority of Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "It is not permissible to combine tax and tithe on a Muslim." So this hadith is false.

(٧٤٩٩) علقمہ (رح) عبداللہ (رض) سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : مسلمان پر ٹیکس اور عشر دونوں جمع نہیں ہوتے۔ سو یہ حدیث باطل ہے۔
