Chapter on permission for one who enters Mecca out of fear of war to enter without Ihram.
باب الرخصة لمن دخلها خائفا لحرب في أن يدخلها بغير إحرام

Anas bin Malik (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings of Allah be upon him) entered (Makkah) in the year of the Conquest of Makkah while he (peace and blessings of Allah be upon him) was wearing a helmet over his head. When he (peace and blessings of Allah be upon him) took it off, a man came and said, "Ibn Khatal is hanging on to the curtains of the Ka'bah." He (peace and blessings of Allah be upon him) said, "Kill him." Malik said that the Messenger of Allah (peace and blessings of Allah be upon him) was not in the state of Ihram at that time.

(٩٨٤٠) انس بن مالک (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) فتح مکہ والے سال داخل ہوئے تو آپ (صلی اللہ علیہ وآلہ وسلم) کے سر پر خود تھی، جب آپ (صلی اللہ علیہ وآلہ وسلم) نے اتاری تو ایک شخص آیا۔ اس نے کہا کہ ابن خطل کعبہ کے پردوں سے لٹکا ہوا ہے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : قتل کر دو۔ مالک فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) اس وقت احرام کی حالت میں نہ تھے۔

Abu Hurairah (may Allah be pleased with him) reported that in the year of the conquest of Makkah, the Prophet (peace and blessings of Allah be upon him) stood up and said, "Allah has withheld the elephants from Makkah and has empowered His Messenger and the believers. It was not lawful for anyone before me, nor will it be lawful for anyone after me, and it has been made lawful for me only for this hour of the day, and this is that very hour."

(٩٨٤٣) ابوہریرہ (رض) سے روایت ہے کہ فتح مکہ والے سال آپ (صلی اللہ علیہ وآلہ وسلم) کھڑے ہوئے اور فرمایا : اللہ نے مکہ سے ہاتھیوں کو روک لیا اپنے رسول اور مومنوں کو مسلط کردیا۔ یہ نہ تو مجھ سے پہلے کسی کے لیے حلال تھا اور نہ ہی میرے بعد اور میرے لیے بھی دن کی اس گھڑی میں جائز قرار دیا گیا ہے اور یہی وہ گھڑی ہے۔
