Chapter on No Renting Allowed until Defined, and the Rent Must Be Defined
باب لا تجوز الإجارة حتى تكون معلومة، وتكون الأجرة معلومة
Sunan al-Kubra Bayhaqi 11651
Narrated Abu Huraira (RA): The Prophet (ﷺ) said: "None of you should try to outbid his brother in a bargain, and none of you should propose marriage to a woman to whom his brother has already proposed, and none of you should outbid the other in an auction, and none of you should conclude a sale by throwing pebbles (as was the practice in bargains for future delivery) and anyone of you who employs someone else should specify the wages he is going to pay him."

(١١٦٥١) حضرت ابوہریرہ (رض) سے روایت ہے کہ آپ نے فرمایا : آدمی اپنے بھائی کے سودے پر سودا نہ کرے اور نہ اپنے بھائی کی منگنی پر منگنی کرے اور نہ بولی لگاؤاور نہ پتھر پھینکنے سے بیع کرو اور جو اجرت پر کسی کو رکھے ، اسے مزدوری طے کر لینی چاہیے۔
Hazrat Abu Huraira (RA) se riwayat hai ki aap ne farmaya : aadmi apne bhai ke saude par sauda na kare aur na apne bhai ki mangni par mangni kare aur na boli lagao aur na pathar phenkne se bech karo aur jo ujrat par kisi ko rakhe, usey mehnatana tay kar leni chahiye.
Auf bin Malik narrates that we were in a battle, and our leader was Amr bin Al-Aas. Among us were Umar bin Khattab and Abu Ubaidah. We became extremely hungry. I went out to search for some work. I found a group of people who wanted to slaughter a camel. I said, "If you wish, I can do this work for you, and you can give me something in return." I butchered the camel. Then I came to Umar. He asked, "Where did you get this from?" I told him, and he said, "You hastened in taking wages and refused food." Then I told Abu Ubaidah, and he also said the same thing as Umar and refused to eat. Seeing this, I left it. He says, "Then we achieved victory, and I came to the Messenger of Allah (peace and blessings be upon him). You (peace and blessings be upon him) said, 'You are the one with the camel,' and did not say anything else to me."
Sheikh says, "The point here is that the wages were unspecified, and the responsibility was for something specific."

(١١٦٥٣) حضرت عوف بن مالک فرماتے ہیں کہ ہم نے جنگ کی اور ہمارے امیر عمرو بن عاص تھے اور ہم میں عمر بن خطاب اور ابو عبیدہ بھی تھے۔ ہمیں شدت کی بھوک لگی۔ میں چلا کہ کوئی کام تلاش کروں۔ میں نے ایک قوم کو پایا وہ اونٹ ذبح کرنا چاہتے تھے۔ میں نے کہا : اگر تم چاہو تو میں تمہارا یہ کام کردیتا ہوں اور مجھے اس سے کچھ دے دینا۔ میں نے گوشت بنایا۔ پھر میں عمر کے پاس آیا۔ انھوں نے سوال کیا : یہ کہاں سے آیا ہے ؟ میں نے بتایا تو انھوں نے کہا : تو نے اجرت میں جلدی کی ہے اور کھانے سے انکار کردیا۔ پھر میں نے ابو عبیدہ کو بتایاتو اس نے بھی حضرت عمر والی بات کہی اور کھانے سے انکار کردیا۔ میں نے یہ دیکھ کر اسے چھوڑ دیا، کہتے ہیں : پھر ہمیں فتح ملی تو میں رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اونٹ والے تم ہو اور مجھے کچھ نہ کہا۔
شیخ فرماتے ہیں : اس میں یہ بات ہے کہ کہ اجرت مجہول تھی اور ذمہ میں چیز نقد تھی۔
Hazrat Auf bin Malik farmate hain ki hum ne jang ki aur humare ameer Amr bin Aas the aur hum mein Umar bin Khattab aur Abu Ubaidah bhi the. Hamein shiddat ki bhook lagi. Main chala ki koi kaam talaash karoon. Main ne ek qaum ko paya woh oonth zabah karna chahte the. Main ne kaha: Agar tum chaho to main tumhara yeh kaam karta hoon aur mujhe is se kuchh de dena. Main ne gosht banaya. Phir main Umar ke paas aaya. Unhon ne sawal kiya: Yeh kahan se aaya hai? Main ne bataya to unhon ne kaha: To ne ujrat mein jaldi ki hai aur khane se inkar kar diya. Phir main ne Abu Ubaidah ko bataya to us ne bhi Hazrat Umar wali baat kahi aur khane se inkar kar diya. Main ne yeh dekh kar use chhor diya, kahte hain: Phir hamein fatah mili to main Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas aaya, aap ((صلى الله عليه وآله وسلم)) ne farmaya: Oont wale tum ho aur mujhe kuchh na kaha.
Sheikh farmate hain: Is mein yeh baat hai ki ki ujrat majhool thi aur zimme mein cheez naqd thi.
(11654) Narrated Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: Give the worker his wages before his sweat dries, and tell him his wages before you employ him.

(١١٦٥٤) حضرت ابو ہریرہ (رض) سے روایت ہے کہ مزدور کو اس کا حق پسینہ خشک ہونے سے پہلے دو اور اس کی مزدوری کام کے حساب سے اسے بتادو۔
(11654) Hazrat Abu Huraira (RA) se riwayat hai ke mazdoor ko uska haq paseena sookhne se pehle do aur uski mehnat ka hisab se use bata do.
Abu Hurairah (may Allah be pleased with him) reported that I was brought up as an orphan and I migrated in a state of poverty and I was a laborer for Abu Ufan and his son Ghazwan for food equivalent to my stomach and for food equivalent to that of my family. When they were at home, I would gather wood, and when they were traveling, I would prepare their luggage.
Now all praise is for Allah, Who strengthened the religion and made Abu Hurairah (may Allah be pleased with him) an Imam.
This does not mean that the Prophet (peace and blessings of Allah be upon him) let it continue after he came to know, and it is likely that there was an agreement between the two rather than a contract.

(١١٦٥٥) حضرت ابو ہریرہ (رض) سے روایت ہے کہ میں نے یتیمی کی حالت میں پرورش پائی اور میں نے مسکینی کی حالت میں ہجرت کی اور میں ابو عفان کے ہاں مزدور تھا اور اس کے بیٹے غزو ان کے ہاں بھی اپنے پیٹ کے بقدر کھانے پر اور اپنے گھر والوں کے کھانے کے بقدر۔ جب وہ گھر پر ہوتے تو لکڑیاں اکٹھی کرتا اور جب وہ سفر پر ہوتے تو اس کا سامان تیار کرتا۔
اب ساری تعریفیں اللہ کے لیے ہیں جس نے دین کو مضبوطی بخشی اور ابو ہریرہ (رض) کو امام بنایا۔
اس میں یہ نہیں ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے جان لینے کے بعد بھی برقرار رہنے دیا اور احتمال ہے کہ یہاں دونوں کے درمیان رضامندی تھی نہ کہ عقد تھا۔
(11655) Hazrat Abu Hurairah (RA) se riwayat hai ki maine yatimi ki halat mein parwarish pai aur maine miskini ki halat mein hijrat ki aur main Abu Ufan ke han mazdoor tha aur uske bete gazu unke han bhi apne pet ke baqadr khane par aur apne ghar walon ke khane ke baqadr. Jab woh ghar par hote toh lakdiyan ikatthi karta aur jab woh safar par hote toh uska saman taiyar karta.
Ab sari tareefain Allah ke liye hain jisne deen ko mazbooti bakhshi aur Abu Hurairah (RA) ko imam banaya.
Is mein yeh nahi hai ki Nabi ((صلى الله عليه وآله وسلم)) ne jaan lene ke baad bhi barqarar rahne diya aur ehtemaal hai ki yahan donon ke darmiyan raza mandi thi na ki aqd tha.
It is also narrated from Ibn 'Abbas (may Allah be pleased with him) that this will be by mutual consent and not by making the (marriage contract) binding.

(١١٦٥٦) ابن عباس (رض) سے بھی منقول ہے کہ یہ دونوں کی رضامندی سے ہوگا نہ کہ ( عقد ) لازم کرنے سے۔
(11656) ibne abbas (rz) se bhi manqol hai keh yeh donon ki raza mandi se hoga na keh (aqd) laazim karne se.
