Chapter on preferring to waive the one-third if his heirs are not wealthy
باب من استحب النقصان عن الثلث إذا لم يترك ورثته أغنياء
Sunan al-Kubra Bayhaqi 12573
Ibn 'Abbas (may Allah be pleased with him) said: "If people were to reduce their wills from a third to a quarter, it would be better, because the Messenger of Allah (peace and blessings of Allah be upon him) said: 'A third is even too much.'"

(١٢٥٧٣) حضرت ابن عباس (رض) فرماتے ہیں : اگر لوگ وصیت میں ثلث سے کم کر کے ربع کردیں تو یہ افضل ہے اس لیے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا تھا : ثلث بھی زیادہ ہے۔
(12573) Hazrat Ibn Abbas (RA) farmate hain : Agar log wasiyat mein suls se kam kar ke rub kar den to ye afzal hai is liye ke Rasool Allah (SAW) ne farmaya tha : Suls bhi ziada hai.
Qatadah said: We were informed that Abu Bakr As-Siddiq (may Allah be pleased with him) made a will regarding a fifth of his wealth, saying: I am not pleased with my wealth in comparison to that with which Allah is pleased, from the spoils of war of the Muslims. And Qatadah said: A fifth is good, and a fourth is a hardship, and a third is what the judge has deemed permissible.

(١٢٥٧٤) قتادہ کہتے ہیں : ہمیں علم ہوا کہ حضرت ابوبکر صدیق (رض) نے اپنے مال سے خمس کی وصیت کی اور کہا : میں اپنے مال سے راضی نہیں ہوں اس چیز کے مقابلے میں جس پر اللہ راضی ہیں مسلمانوں کی غنیمتوں میں سے اور قتادہ نے کہا : خمس اچھا ہے اور ربع مشقت ہے اور ثلث اس کو قاضی نے جائز قرار دیا ہے۔
Qatada kahte hain humen ilm hua ke Hazrat Abu Bakr Siddiq (RA) ne apne maal se khums ki wasiyat ki aur kaha main apne maal se razi nahin hun is cheez ke muqable mein jis par Allah razi hain Musalmanon ki ghanimaton mein se aur Qatada ne kaha khums acha hai aur rub mushkil hai aur sulus us ko qazi ne jaiz karar diya hai
It has been narrated on the authority of Ibn 'Abbas (may Allah be pleased with him), regarding the person who bequeaths one-fifth (of his wealth), that he is better than the one who bequeaths one-fourth, and the one who bequeaths one-fourth is better than the one who bequeaths one-third.

(١٢٥٧٥) حضرت ابن عباس (رض) سے اس شخص کے بارے جس نے خمس کی وصیت کی منقول ہے وہ اس سے افضل ہے جس نے ربع کی وصیت کی اور وہ افضل ہے جس نے ربع کی وصیت کی اس سے جس نے ثلث کی وصیت کی۔
hazrat ibn abbas (rz) se is shakhs ke bare jis ne khums ki wasiyat ki manqol hai wo is se afzal hai jis ne ruba ki wasiyat ki aur wo afzal hai jis ne ruba ki wasiyat ki is se jis ne suls ki wasiyat ki.
Ali (RA) said: Leaving a quarter of one's wealth as a will is more preferable to me than leaving a third, so whoever has bequeathed a third, they should not change it.

(١٢٥٧٦) حضرت علی (رض) نے فرمایا : میرے نزدیک ربع کی وصیت کرنا ثلث سے زیادہ پسندیدہ ہے، پس جس نے ثلث کی وصیت کی وہ اسے نہ چھوڑے۔
(12576) Hazrat Ali (RA) ne farmaya : mere nazdeek rubah ki wasiyat karna suls se zyada pasandida hai, pas jis ne suls ki wasiyat ki wo use na chhore.
