Chapter on what is mentioned in the verse: 'When the division is attended by relatives and orphans and the needy, give them from it and say to them a noble saying'
باب ما جاء في قوله تعالى وإذا حضر القسمة أولو القربى واليتامى والمساكين فارزقوهم منه وقولوا لهم قولا معروفا
Sunan al-Kubra Bayhaqi 12555
(12555) It is narrated from Ibn 'Abbas (may Allah be pleased with him) that this verse is firm and not abrogated.

(١٢٥٥٥) حضرت ابن عباس (رض) سے روایت ہے کہ یہ آیت محکم ہے منسوخ نہیں ہے۔
(12555) Hazrat Ibn Abbas (RA) se riwayat hai keh yeh ayat muhkam hai mansukh nahin hai.
Narrated Ibn 'Abbas (RA): People claim this Verse has been abrogated. But by Allah! It has not been abrogated. It is just that people have become lazy in acting upon it. Those who ask for inheritance are of two kinds: those who are themselves heirs, they are commanded to give (to others). And those who are not heirs themselves, they are commanded to respond gently, saying: "This is the wealth of the orphans, and I have nothing to do with it."

(١٢٥٥٧) حضرت ابن عباس (رض) سے روایت ہے کہ لوگ کہتے ہیں : یہ آیت منسوخ ہوچکی ہے، لیکن اللہ کی قسم ! وہ منسوخ نہیں ہوئی۔ البتہ لوگ اس پر عمل کرنے میں سست ہوگئے۔ ترکہ لینے والے دو طرح کے ہوتے ہیں : ایک وہ جو خود وارث ہوں ان کو تو (دوسروں کو) دینے کا حکم ہے دوسرے وہ جو خود وارث نہ ہوں ان کو نرمی سے جواب دینے کا حکم ہے اور وہ کہہ دے : یہ یتیموں کا مال ہے میرا اس میں کچھ نہیں ہے۔
Hazrat Ibn Abbas (RA) se riwayat hai ki log kahte hain : ye aayat mansookh ho chuki hai, lekin Allah ki qasam ! wo mansookh nahi hui. Albatta log us par amal karne mein sust ho gaye. Tarka lene wale do tarah ke hote hain : ek wo jo khud waris hon un ko to (dusron ko) dene ka hukm hai dusre wo jo khud waris na hon un ko narmi se jawab dene ka hukm hai aur wo kah de : ye yatimon ka maal hai mera is mein kuch nahi hai.
(12558) Abdullah bin Abdur Rahman distributed the inheritance of his father Abdur Rahman while Aisha (may Allah be pleased with her) was alive. He left nothing in the house: he gave everything from his father's inheritance to the poor and relatives and recited the verse: {And when (the distribution of) the inheritance is witnessed by the relatives and the orphans and the needy...}
Qasim says: I mentioned this to Ibn Abbas (may Allah be pleased with him) so he said: The way he did is not correct. This is only in the case of a will and this verse is also about a will that the dying person should intend to make.

(١٢٥٥٨) عبداللہ بن عبدالرحمن نے اپنے والدعبدالرحمن کی میراث تقسیم کی اور حضرت عائشہ (رض) زندہ تھیں، انھوں نے گھر میں کچھ نہ چھوڑا : مسکین، رشتہ دار سب کو باپ کی وراثت سے دے دیا اور آیت تلاوت کی : { وَإِذَا حَضَرَ الْقِسْمَۃَ أُولُو الْقُرْبَی وَالْیَتَامَی وَالْمَسَاکِینُ }
قاسم کہتے ہیں : میں نے ابن عباس (رض) سے ذکر کیا تو انھوں نے کہا : جس طرح اس نے کیا ایسے صحیح نہیں ہے۔ ایسا تو وصیت میں ہے اور یہ آیت بھی وصیت کے متعلق ہے کہ میت وصیت کرنے کا ارادہ رکھے۔
12558 Abdullah bin Abdurrahman ne apne walid Abdurrahman ki miraas taqsim ki aur Hazrat Ayesha zinda thin, unhon ne ghar mein kuch na chhoda: miskeen, rishtedaar sab ko baap ki wirasat se de diya aur aayat tilawat ki: {wa iza hadar alqismata ulu alquraba walyatama walmasakin} Qasim kehte hain: maine Ibn Abbas se zikar kiya to unhon ne kaha: jis tarah usne kiya aise sahih nahin hai. Aisa to wasiyat mein hai aur ye aayat bhi wasiyat ke mutalliq hai ke mayyat wasiyat karne ka irada rakhe.
(12559) Said bin Musayyab said regarding the verse: {And give the relatives their rights, and the orphans, and the needy. So give them a portion of it}, that the obligatory shares of inheritance have abrogated it.

(١٢٥٥٩) سعید بن مسیب { وَإِذَا حَضَرَ الْقِسْمَۃَ أُولُو الْقُرْبَی وَالْیَتَامَی وَالْمَسَاکِینُ فَارْزُقُوہُمْ مِنْہُ } کے بارے میں کہتے ہیں : اس کو فرائض نے منسوخ کردیا۔
