Sunan al-Kubra Bayhaqi 13735
A woman was brought to Umar bin Khattab (R.A.) who had married her slave. The woman said: “Did Allah Almighty not say in the Holy Quran: { أَوْ مَا مَلَکَتْ أَیْمَانُکُمْ } what your right hands possess.” Umar (R.A.) implemented the prescribed punishment on both of them and separated them. He wrote a letter to the governors that whichever woman marries her slave or marries without a witness or without a guardian, then implement the prescribed punishment on both of them.

(١٣٧٣٥) حضرت عمر بن خطاب (رض) کے پاس ایک عورت کو لایا گیا جس نے اپنے غلام سے شادی کرلی تھی۔ عورت نے کہا : کیا اللہ پاک نے قرآن مجید میں ارشاد نہیں فرمایا : { أَوْ مَا مَلَکَتْ أَیْمَانُکُمْ } جو مالک ہوئے تمہارے دائیں ہاتھ کے۔ حضرت عمر (رض) نے ان دونوں پر حد لگائی اور ان کے درمیان تفریق ڈال دی اور گورنروں کی طرف یہ خط لکھا کہ جو عورت بھی اپنے غلام سے شادی کرے یا بغیر دلیل کے شادی کرے یا ولی کے بغیر تو ان دونوں پر حد نافذ کرو۔
Hazrat Umar bin Khattab (RA) ke paas ek aurat ko laya gaya jis ne apne ghulam se shadi kar li thi. Aurat ne kaha: kya Allah Pak ne Quran Majeed mein irshad nahin farmaya: {aw maa malakat aymanukum} jo malik huye tumhare dayen hath ke. Hazrat Umar (RA) ne in donon par had lagai aur in ke darmiyan tafreeq dal di aur governoro ki taraf ye khat likha ke jo aurat bhi apne ghulam se shadi kare ya baghair daleel ke shadi kare ya wali ke baghair to in donon par had nafiz karo.
A woman was brought to Umar bin Khattab (may Allah be pleased with him) who had married her slave. He punished her, separated them, and made her husband unlawful for her as a punishment.

(١٣٧٣٦) حضرت عمر بن خطاب (رض) کے پاس ایک عورت کو لایا گیا جس نے اپنے غلام سے شادی کرلی۔ اس کو سزا دی اور ان دونوں کے درمیان تفریق کردی اور اس کو سزا دینے کے لیے اس پر خاوند کو حرام قرار دے دیا۔
Hazrat Umar bin Khattab (RA) ke paas ek aurat ko laya gaya jis ne apne ghulam se shaadi karli. Is ko saza di aur in donon ke darmiyaan tafreeq kar di aur is ko saza dene ke liye is par khawand ko haram qarar de diya.
It is narrated on the authority of Sayyidina Ali (may Allah be pleased with him) that a woman inherited a slave from her husband's property. This matter was presented before Sayyidina Ali (may Allah be pleased with him). He asked (the slave), "Did you have sexual intercourse with her?". He replied, "No." Sayyidina Ali (may Allah be pleased with him) said, "If you had slept with her, I would have stoned you." Then he said to the woman, "He is your slave. If you want, sell him, if you want, gift him, and if you want, set him free and marry him."

(١٣٧٣٧) سیدنا علی (رض) سے روایت ہے کہ ایک عورت اپنے خاوند کے مال میں ایک غلام کی وارث بنی تو یہ معاملہ سیدنا علی (رض) کے سامنے پیش کیا گیا تو انھوں نے (اس غلام سے) کہا : کیا تو نے اس سے ہم بستری کی ؟ اس نے کہا : نہیں، سیدنا علی (رض) نے فرمایا : اگر تو نے ہم بستری کی ہوتی تو میں تجھ کو سنگسار کردیتا، پھر اس عورت سے کہا : وہ تیرا غلام ہے اگر چاہے تو بیچ دے اگر چاہے ہبہ کر دے اگر چاہے تو اس کو آزاد کر کے اس سے شادی کرلے۔
(13737) Syedna Ali (RA) se riwayat hai keh aik aurat apne khaavand ke maal mein aik ghulam ki waris bani to yeh mamla Syedna Ali (RA) ke samne pesh kia gya to unhon ne (is ghulam se) kaha: kia too ne is se humbistari ki? Us ne kaha: nahin, Syedna Ali (RA) ne farmaya: agar too ne humbistari ki hoti to main tuj ko sangsar karta, phir is aurat se kaha: woh tera ghulam hai agar chahe to bech de agar chahe hiba kar de agar chahe to is ko azad kar ke is se shadi karle.
