Sunan al-Kubra Bayhaqi 16093
Abu Nadra narrated that a man came to Umar while he was on the pulpit, and said, "Your employee hit me and wronged me." Umar said, "By Allah, I will take retaliation for you." Amr bin Al-Aas said, "O leader of the believers! Will you take retaliation from your employee?" He said, "Yes, I will take retaliation from him. The Messenger of Allah and Abu Bakr took retaliation, so should I not take retaliation from him?" Amr bin Al-Aas said, "Is there nothing else besides that?" He asked, "What is that?" He said, "That the oppressed person be satisfied." He said, "Good, whatever the oppressed person is satisfied with."

(١٦٠٩٣) ابونضر فرماتے ہیں کہ ایک شخص حضرت عمر کے پاس آیا اور وہ منبر پر کھڑے تھے، کہنے لگا کہ آپ کے عامل نے مجھے مارا ہے اور مجھ پر ظلم کیا ہے۔ حضرت عمر فرمانے لگے : اللہ کی قسم ! تمہیں ضرور قصاص لے کر دوں گا۔ عمرو بن عاص فرمانے لگے : اے امیر المؤمنین ! کیا آپ اپنے عامل سے قصاص لیں گے۔ فرمایا : ہاں میں اس سے ضرور قصاص لوں گا۔ اللہ کے رسول اور حضرت ابوبکر نے خود قصاص دیا ہے تو کیا میں اس سے قصاص نہ لوں ؟ عمرو بن العاص فرمانے لگے : کیا اس کے علاوہ اور کچھ نہیں ہوسکتا ؟ پوچھا : وہ کیا ؟ فرمانے لگے : جس پر وہ رضا مند ہوجائے۔ فرمایا : ٹھیک ہے جس پر مظلوم رضا مند ہوجائے۔
(16093) Abu Nadr farmate hain ki aik shakhs Hazrat Umar ke paas aaya aur wo mimbar par kharay thay, kehne laga ki aap ke aamil ne mujhe mara hai aur mujh par zulm kiya hai. Hazrat Umar farmane lage : Allah ki qasam! tumhen zaroor qisas lekar doon ga. Amr bin Aas farmane lage : Ae Ameerul Momineen! kya aap apne aamil se qisas lenge. Farmaya : haan main us se zaroor qisas loon ga. Allah ke Rasool aur Hazrat Abu Bakr ne khud qisas diya hai to kya main us se qisas na loon? Amr bin al-Aas farmane lage : kya is ke ilawa aur kuchh nahin hosakta? Poocha : wo kya? Farmane lage : jis par wo raza mand hojae. Farmaya : theek hai jis par mazloom raza mand hojae.
Ibn Abbas (may Allah be pleased with him) said, regarding Allah's statement: "{A life for a life}," that a life will be taken for a life, an eye will be gouged for an eye, a nose will be cut for a nose, a tooth will be extracted for a tooth, and retaliation will be taken for wounds. In these matters, Muslims, freemen, men, and women are all equal, when these acts are committed intentionally.

(١٦٠٩٤) ابن عباس (رض) اللہ کے اس فرمان { النَّفْسُ بِالنَّفْسِ } کے بارے میں فرماتے ہیں کہ نفس کو نفس کے بدلے قتل کیا جائے گا، آنکھ آنکھ کے بدلے پھوڑی جائے گی، ناک ناک کے بدلے کاٹا جائے گا، دانت دانت کے بدلے اکھاڑا جائے گا، اور زخم کے بدلے زخم کا قصاص لیا جائے گا، ان اشیاء میں مسلمان، آزاد، مرد اور عورتیں تمام برابر ہیں جب یہ کام جان بوجھ کر کیے جائیں۔
16094 Ibn Abbas (RA) Allah ke is farman { alnnafsu bilnnafsi } ke bare mein farmate hain ke nafs ko nafs ke badle qatl kiya jayega aankh aankh ke badle phodi jayegi naak naak ke badle kata jayega dant dant ke badle ukhada jayega aur zakhm ke badle zakhm ka qisas liya jayega in ashiya mein musalman azad mard aur aurten tamam barabar hain jab ye kaam jaan boojh kar kiye jayen
Anas (may Allah be pleased with him) reported: The sister of Rubi' (may Allah be pleased with him), Umm Haritha, wounded a person. The dispute was brought to the Prophet (peace and blessings be upon him) and he gave the verdict of retaliation. Umm Rubi' said: "O Messenger of Allah! Should there be retaliation for such and such (i.e. the private part)?" By Allah, never! The Prophet (peace and blessings be upon him) said: "Retaliation is in the Book of Allah." She said: "By Allah, retaliation can never be taken." She kept on saying this until they (the relatives of the deceased) agreed to accept blood-money. Thereupon, the Prophet (peace and blessings be upon him) said: "Indeed, there are some servants of Allah who, if they were to swear by Allah, Allah would fulfill their oaths."

(١٦٠٩٥) انس (رض) فرماتے ہیں کہ ربیع کی بہن ام حارثہ نے ایک انسان کو زخمی کردیا۔ جھگڑا نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آگیا تو آپ نے فیصلہ فرمایا کہ قصاص ہوگا۔ ام ربیع کہنے لگی : اے اللہ کے رسول ! کیا فلانہ سے بھی قصاص لیا جائے گا ؟ اللہ کی قسم ! ہرگز نہیں۔ تو نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ کی کتاب میں قصاص ہی ہے۔ تو وہ کہنے لگی : اللہ کی قسم ! قصاص کبھی نہیں لیا جاسکتا، وہ ہمیشہ یہی کہتی رہی یہاں تک کہ وہ لوگ دیت پر راضی ہوگئے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ کے کتنے ہی ایسے بندے ہیں کہ اگر وہ اللہ پر قسم اٹھالیں تو اللہ ان کو بری کردیتے ہیں۔
(16095) Anas (Razi Allahu Anhu) farmate hain ki Rabia ki behan Umme Haritha ne ek insan ko zakhmi kar diya. Jhagra Nabi ((صلى الله عليه وآله وسلم)) ke paas aa gaya to aap ne faisla farmaya ki qisas hoga. Umme Rabia kehne lagi: Aye Allah ke Rasool! Kya falan se bhi qisas liya jaye ga? Allah ki qasam! Hargiz nahin. To Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Allah ki kitab mein qisas hi hai. To wo kehne lagi: Allah ki qasam! Qisas kabhi nahin liya ja sakta, wo hamesha yahi kehti rahi yahan tak ke wo log diyat par raazi ho gaye to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Allah ke kitne hi aise bande hain ki agar wo Allah par qasam utha len to Allah unko bari kar dete hain.
Anas narrates that Rabia bint Nadir slapped a slave girl and broke her incisor tooth. She asked for forgiveness, but the slave girl refused. She offered compensation, but she still refused. The matter was brought to the Prophet (peace and blessings be upon him), and he ordered retribution. Anas bin Nadir said, "O Messenger of Allah! Should Rabia's incisor tooth also be broken? By the One who sent you with the truth, that cannot be!" So you (peace and blessings be upon him) said, "O Anas! The judgment of Allah's Book is retribution." The tribe agreed to accept compensation, so you said, "Among the servants of Allah are those whose oaths, if they swear by Allah, He fulfills."

(١٦٠٩٦) حضرت انس فرماتے ہیں ربیع بنت نضر نے ایک لونڈی کو تھپڑ مارا اور اس کے ثنیہ دانت توڑ دیے، انھوں نے معافی مانگی لیکن انھوں نے انکار کردیا۔ انھوں نے دیت کی بات کی تو بھی انکار کردیا۔ فیصلہ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا تو آپ نے قصاص کا حکم دے دیا۔ انس بن نضر کہنے لگے : اے اللہ کے رسول ! کیا ربیع کے بھی ثنیہ دانت توڑے جائیں گے ؟ قسم ہے اس ذات کی جس نے آپ کو حق کے ساتھ بھیجا ایسا نہیں ہوسکتا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اے انس ! کتاب اللہ کا فیصلہ قصاص ہے۔ قوم دیت پر راضی ہوگئی تو آپ نے فرمایا : اللہ کے بندوں میں ایسے بھی ہیں کہ اگر وہ اللہ پر قسم اٹھالیں تو اللہ ان کی قسم پوری فرما دیتے ہیں۔
Hazrat Anas farmate hain Rabia bint Nazar ne ek laundi ko thappar mara aur uske saniyah daant tod diye, unhon ne maafi mangi lekin unhon ne inkar kar diya. Unhon ne deet ki baat ki to bhi inkar kar diya. Faisla Nabi ((صلى الله عليه وآله وسلم)) ke paas aaya to aap ne qisas ka hukum de diya. Anas bin Nazar kahne lage : Aye Allah ke Rasool ! kya Rabia ke bhi saniyah daant tore jayenge ? Kasam hai is zaat ki jisne aap ko haq ke sath bheja aisa nahi ho sakta to aap ((صلى الله عليه وآله وسلم)) ne farmaya : Aye Anas ! kitab Allah ka faisla qisas hai. Qaum deet par raazi ho gayi to aap ne farmaya : Allah ke bandon mein aise bhi hain ki agar wo Allah par qasam utha lein to Allah unki qasam puri farma dete hain.
