Chapter on what is mentioned about expiation for causing harm to a fetus and similar cases
باب ما جاء في الكفارة في الجنين وغير ذلك
Sunan al-Kubra Bayhaqi 16420
Malik b. Anas reported from Imam Zuhri that a person struck a woman and she had a miscarriage. Ibn Shihab said: There is a fine upon him (the person who struck) for her child, and there is expiation upon him.

(١٦٤٢٠) مالک بن انس امام زہری سے روایت کرتے ہیں کہ ایک آدمی نے ایک عورت کو مارا، جس سے اس کا حمل ساقط ہوگیا۔ ابن شہاب کہتے ہیں کہ اس کے بچے کے بدلے اس پر جرمانہ ہے اور اس پر کفارہ ہے۔
(16420) Malik bin Anas Imam Zuhri se riwayat karte hain ki ek aadmi ne ek aurat ko mara, jis se us ka hamal saqit hogaya. Ibn Shahab kehte hain ki us ke bache ke badle us par jurmana hai aur us par kaffara hai.
Ibn Shihab said: A woman was beaten, she had three miscarriages in her womb. Zuhri said: For every one, according to our opinion, there is a fine. Yunus said: Ibn Shihab said regarding the woman who was beaten by a man, and died, and her pregnancy was also wasted: The blood money of the woman is to be paid, as for the child, it was with the woman, there is no blood money for it in our opinion.

(١٦٤٢١) ابن شہاب کہتے ہیں کہ ایک عورت کو مارا گیا، اس کے پیٹ میں ٣ بچے تھے جو ساقط ہوگئے تو زہری کہتے ہیں کہ ہر ایک کے بدلے ہماری رائے کے مطابق جرمانہ ہے۔ یونس کہتے ہیں کہ ابن شہاب نے اس عورت کے بارے میں فرمایا کہ جس کو ایک شخص نے مارا، وہ مرگئی اور اس کا حمل بھی ضائع ہوگیا فرمایا : عورت کی تو دیت ہے، رہا بچہ تو وہ بھی عورت کے ساتھ تھا اس کی کوئی دیت ہمارے خیال میں نہیں ہے۔
16421 ibn shahab kehte hain ke ek aurat ko mara gaya, us ke pet mein 3 bache thy jo saqit hogaye to zahri kehte hain ke har ek ke badle hamari rae ke mutabiq jurmana hai. younas kehte hain ke ibn shahab ne us aurat ke bare mein farmaya ke jis ko ek shakhs ne mara, woh mar gayi aur us ka hamal bhi zaya hogaya farmaya: aurat ki to deet hai, raha bacha to woh bhi aurat ke sath tha us ki koi deet hamare khayal mein nahi hai.
Abu Zanad narrates from the jurists of Medina, among the Successors, regarding a person who strikes a woman, causing her to miscarry. If the fetus is stillborn, then there is a fine. But if it is born alive and then dies, then full compensation is due. And they used to say that if a pregnant woman is killed and the child is in her womb, then only the blood money for the woman is due, not for the child.

(١٦٤٢٢) ابوزناد فقہاء مدینہ تابعین سے نقل کرتے ہیں کہ وہ اس شخص کے بارے میں فرماتے ہیں جو مار کر عورت کا حمل ضائع کر دے۔ اگر وہ مردہ ہی ساقط ہوا ہے تو اس میں جرمانہ اور اگر زندہ ساقط ہوا ہے بعد میں مرا ہے تو مکمل دیت ہے اور وہ فرماتے تھے کہ جو حاملہ قتل کی جائے اور بچہ اس کے پیٹ ہی میں ہو تو صرف عورت کی دیت ہوگی بچے کی نہیں۔
(16422) Abu Zanad fuqaa Madinah Tabioon se naql karte hain ki woh is shakhs ke bare mein farmate hain jo maar kar aurat ka hamal zaya kar de agar woh murda hi saqit hua hai to us mein jurmana aur agar zinda saqit hua hai baad mein mara hai to mukammal deet hai aur woh farmate the ki jo hamila qatl ki jaye aur bachcha us ke pet hi mein ho to sirf aurat ki deet hogi bachche ki nahin.
Umar (RA) narrated that Qais bin Asim Tamimi came to the Prophet (PBUH) and said: I had buried alive 8 daughters in the days of ignorance. He (PBUH) said: Free a slave for each one of them.

(١٦٤٢٤) حضرت عمر (رض) فرماتے ہیں کہ قیس بن عاصم تمیمی نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا اور کہا : میں نے جاہلیت میں ٨ بیٹیوں کو زندہ درگور کیا تھا تو آپ نے فرمایا : ہر ایک کے بدلے ایک جان آزاد کر۔
Hazrat Umar (RA) farmate hain ke Qais bin Asim Tamimi Nabi (SAW) ke pass aaya aur kaha: mein ne jahiliyat mein 8 betiyon ko zinda dargor kiya tha to aap ne farmaya: har ek ke badle ek jaan azad kar.
Qais ibn 'Asim reported: I came to the Prophet (ﷺ) and said: I had buried alive 12 or 13 daughters during the pre-Islamic period. The Prophet (ﷺ) said: Free a slave for each one of them.

(١٦٤٢٥) قیس بن عاصم کہتے ہیں کہ میں نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا اور کہا : میں نے جاہلیت میں ١٢ یا ١٣ بچیاں زندہ درگور کیں تو آپ نے فرمایا : ان کی تعداد کے مطابق گردن آزاد کر دے۔
Qais bin Asim kehte hain ke main Nabi ((صلى الله عليه وآله وسلم)) ke paas aaya aur kaha : main ne jahiliyat mein 12 ya 13 bachiyan zinda dargor kin to aap ne farmaya : in ki tadaad ke mutabiq gardan aazaad kar de.
Shahr bin Hawshab narrates that Umar (may Allah be pleased with him) once scolded a woman very harshly, and as a result, she suffered a miscarriage. Umar paid the penalty for it.

(١٦٤٢٦) شہر بن حوشب فرماتے ہیں کہ حضرت عمر (رض) نے ایک عورت کو بہت زور سے ڈانٹا تو اس عورت کا بچہ ساقط ہوگیا تو حضرت عمر نے اس کا جرمانہ ادا کیا۔
(16426) Shehr bin Hawshab farmate hain ke Hazrat Umar (RA) ne ek aurat ko bohat zor se danta to us aurat ka bachcha saqit hogaya to Hazrat Umar ne uska jurmana ada kiya.
